debted to the Said Jonathan in the Sume of five hundred fifety three lbs. of
Tobacco being as well for Severall Licquors Ordinary Accomadations by the Said
Jonathan Sold and Delivered as allso for Credditt given to one Nicholas White as
by a Perticular account thereof here ready in Court to be Produced may more att
Large appear and the Said William to the Said Jonathan in manner aforesaid
being Indebted in Consideration thereof did assume upon himselfe and to the
Said Jonathan then and there faithfully Promise that he the Said William the
Said Sume of 553 lbs. of Tobacco to the Said Jonathan when he Should be after-
wards thereunto requested would well and truely Content and pay Nevertheless
the Said William his Promise and assumption soe as aforesaid made little regard-
ing but mindeing and Fraudulently intending him the Said Jonathan in his Life
time Craftily and Subtilly to deceive and defraud the Said Sume of 553 lbs. of
Tobacco or any Part thereof to the Said Jonathan in his Life time or to the Said
Kathrine and Joshua or to Either of them After the Death of the Said Jonathan
to whom Execution of the Last Will and Testament of the Said Jonathan since
his Death hath been Leagally Committed hath not paid although the Said
William to doe the Same by the Said Jonathan in his Life time Afterwards the
Day and Place aforesaid and by the Said Kathrine and Joshua at Severall dayes
and times Since the Death of the Said Jonathan att Charles Towne aforeSaid hath
been often thereunto requested but the Said William the Same to pay to the Said
Jonathan in his Life time or to the Said Kathrine and Joshua Since the Death
of the Said Jonathan hath refused and Still doth denye and refuse to the Damage
of the Said Kathrine and Joshua of 1000 lbs. of Tobacco and thereupon they
bring their Suite etc.

And they bring into Court the Letters Testementary etc. that it may the Plainer
appear etc.

And the Said William Greenup comes in his Propper Person and defends the
force and Injury when etc. and Prayeth Licence to imparle here untill the next
Court Comeing and it is Granted unto him the Same Day is given to the Defend-
ants Likewise. Att which day (to Witt) the 26th day of September Annoque
Domini 1699 here came as well Joshua Cecell and Kathrine Willson Plantives as
the Said William Greenup in his propper person and the Said Plantiffe Prayeth
that the Defendant to their Declaration aforesaid May answar.

And the Said William Greenup by William Stone his attorney comes and de-
fends the force and Injury when etc. and Saith that he doth not owe the Said
