And the Said William Stimpson by Joshua Cecell his attorney comes and de-
fends the force and Injury when etc. and Saith that he did not assume in manner
and forme alleadgeing that the account Speacifyed in the above Declaration was
not proovd according to Law and putts himselfe upon the Court by Consent.

[486] Therefore it is Considered by the Court that the Said Robert Mason
Plantiff takes nothing by his Seid writt but be in mercy for his falce Clammour
and lett the names of the Pledges be Sought for and the Said William Stimpson
Defendant goe thereof without day etc.

It is Likewise Considered that the Said William Stimpson Defendant doe
recover against the Said Robert Mason Plantiffe for the Sume of three hundred
and Nine lbs. of Tobacco his Damages by Occation of the Premisses by the Dis-
cression of the Justices here to the Said William Stimpson for his Costs and
Charges by him in this Part Susteined according to the forme of the Statute etc.
by the Court here adjudged, etc.

Hugh Fergison Plantiff: Treacys Administrator Defendant

The Plantife by William Stone his attorney Brought his Majestys writt against
the Defendant in a plea of tresspass upon the Case etc. it being for fourteen hun-
dred and twenty pounds of Tobacco due upon the Ballance of accounts And
David Small Administrator of the Said Treacy by Joshua Cecell his Attorney
cometh and Defendeth the force and Injury when etc. And Prayeth Leave to have
auditors assigned him to hear and Adjust accompts between him and the Said
Plantiffe According to an Ordinance of Assembly in Such Cases made and pro-
vided etc. And by the Court auditors are assigned him that is to Say Christopher
Baines and Paule Bussey Who are hereby Ordered to here and adjust accompts
between the Parties afforesaid and to returne their audict this afternoon.

the Said David Small administrator of all the Goods Chatties and Credditts of
Charles Treacy Deceased and the auditors Likewise came and made report of
their audict as Followeth

Wee the Subscribers have audited and Stated accomps between the Parties
afforesaid according to the abovesaid Order of Court and we Find the Said Charles
