566 PRINCE GEORGES COUNTY

And whereupon the Said Timothy by William Stone his Attorney Compleineth
that whereas the Said Ambross the 18th day of March in the year of our Lord
1697 [1698] att Charles Towne within the Jurisdiction of this Court Stood in-
debted unto the Said Timothy in the Sume of Eight Hundred Pounds of Tobacco
being as well for accomadation as for Severall hogsheads of Indian Corne as by a
Perticular account thereof here ready in Court to be produced more att Large
may appear and the Said Ambross to the Said Timothy being Soe indebted as afore-
said in Consideration thereof did assume upon himselfe and to the Said Timothy
then and there faithfully Promise that he the Said Ambross the Said Sume of
800 pounds of Tobacco to the Said Timothy when he Should be thereunto re-
quested would well and truely Content and pay Nevertheless the Said Ambross
his promise and assumption aforesaid not regarding but mindeing and fraudu-
lently intending him the Said Timothy in this behalfe Craftily and Subtilly to
deceive and defraud the Said Sume of 800 lbs. of Tobacco or any part thereof to
the Said Timothy hath not paid although the Said Ambross to doe the Same by
the Said Timothy afterwards the Day and place aforesaid was often thereunto
requested but hath hitherto refused and Still doth refuse to the Damage of the
Said Timothy the Sume of 1160 lbs. of Tobacco and thereupon he brings this
Suite etc.

[479] And the Said Ambross Shippwash by Joshua Cecell his Attorney cometh
and defendeth the force and Injury when etc. and prayeth Lycence thereof to im-
parle here untill the next Court and it is Granted unto him the Same day is given
to the Said Timothy Mayhall plantife Likewise.

Att which day (to witt) the 26th day of September Annoque Domini 1699 here
came as well the Said Timothy Mayhall plantiff by William Stone his Attorney
aforesaid as allso the Said Ambross Shippwash Defendant by his attorney afore-
said, And the Defendant by Joshua Cecell his Attorney cometh and defendeth the
force and Injury when etc. and Saith that he oweth not the Said Plantiffe the
Said Eight hundred pounds of Tobacco or any part thereof as the Said Timothy
Mahony hath declared against him and of this he putts himselfe upon the Court.

The Court haveing read and Fully understood the Alligations of the Parties on
both Sides and the wittnesses on both Sides being fully heard by the Assent of the
Parties Aforesaid, etc.

Therefore it is Considered by the Court that the aforesaid Timothy Mayhall
Plantiffe doe recover against the aforesaid Ambross Shippwash Defendant as well
the Sume of Eight hundred pounds of Tobacco his Debt aforesaid as allsoe the
Sume of three hundred and Six pounds of Tobacco Costs of Suite of his assent by
the Court here adjudged and the Said Ambross Shippwash be in mercy.

Thomas Stafford Late of Prince Georges County Planter was atteached to
answer unto Edward Battson of a plea of trespass upon the Case.
