there are Severall Judgements due to Severall people obteined against the De-
ceased in his Life time which yet remaines unsattisfyed out of the Said Deceaseds
Esteate as to Elizabeth Wattkeson Executrix of the Last Will and Testament
of Cornelius Wattkinson Deceased the Sume of 700 pounds of Tobacco as by
the records of Callvert County appeareth and that the Said Defendants hath not
in their hands assetts to satisfie the Plantiffs debt Sued for whereupon they Pray
Judgement of this Court if the Said Plantifs their Said action against them
ought to have etc.

And the Plantives by their attorney aforesaid Saith that he ought not to be
barrd of his action aforesaid by the Plea aforesaid because that he Saith that
admitting it be true as is alleadged by the Defendants in the plea aforesaid
that is to Say that there is Debts Due from the Esteate of the Said Jonathan
Willson Deceased of a Hyar nature then then the Said Williams and Company
mentioned in the Declaration yet by Protestation they Say that there is a Con-
siderable List of Debts due to Esteat of the Said Jonathan Willson deceased
from Severall persons which will bee assetts in the hands of the Said Executors
when received beyond the Said Debts of a hyar nature now mentioned in the
Plea aforesaid therefore the Plantives prayes Judgement against the Said Execu-
tors for his Debt aforesaid to be paid out of the List aforesaid when the Same
Shall be received by the Said Executors and of this he Prayeth Judgement.

And the Said Kathrine and Joshua as formarly Saith that the Said William
Round and Company their action aforesaid against them the Said Kathrine
and Joshua ought not to have for the Debt in the Plantiffs Declaration men-
tioned because the Said Defendants Saith as in their Plea aforesaid that there
is Several Debts due from the Said Deceaseds Esteate of a hyar nature then the
Plantiffs debts Sued for and that they ought not to be Charged with any assetts
upon any lost of Debts due to the Said Deceaseds Esteat untill the Said Debts
are by the Said Executors Received the which they are ready to aver and of this
they putts themselves upon the Court by Consent. Joshua Cecell

The Pleadeings on boath Sides by the Court having Fully read seen and
understood it is Considered that the aforesaid William Round and Company
Plantiffe doe recover against the aforsaid Kathrine Willson and Joshua Cecell
Executors of the aforesaid Jonathan Willson Deceased as well the Sume of fife-
teen pounds Sterling their Debt aforesaid as allso the Sume of four hundred
Eighty Eight pounds of Tobacco for their Cost and Charges of Suite to the
Said William Round and Company Plantiff of their assent by the Court here
adjudged out of the Goods and Chatties whereof Jonathan Willson att the
time of his Death in the hands of the Said Kathrine Willson and Joshua Cecell
to be administred if they have Soe much thereof in their hands to be admin-
istred and the Said Kathrine Willson and Joshua Cecell in mercy.

Kathrine Willson and Joshua Cecell Late of Prince Georges County Execu-
tors of the Last will and testament of Jonathan Willson Deceased was attached
to answare unto William Round of a Plea of trespass upon the Case.
And whereupon the Said William by William Stone his Attorney Compleineth
that whereas the Said Jonathan in his Lifetime that is to Say the 11th day of
March in the year of our Lord 1695/6 att Callvert County that is to Say att
