form aforesaid assent as allso the Sume of thirteen hundred fifety four pounds
of Tobacco to the Said Plantiffe at his request for his Cost and Charges of Suite
by the Court here adjudged and the Said John Bowl ton Defendant be in mercy.
The Court adjourned till tomorrow morneing Eight of the Clocke.
Present. Mr. Thomas Hollyday, Mr. Robert Bradley, Mr. Samuell Magruder,
Mr. James Stoddart.
Jonathan Goosey Sworne as an Evidence for Mr. William Willkeson against
John Bowlton.
Martha Goosey Summoned and sworne as an Evidence for Mr. Willkeson
against John Bowlton.
John Burras Sworne as an Evidence for Mr. Willkeson against John Bowlton.
William Carter Sworne as an Evidence for Mr. Willkeson against John Boul-
ton.
Jonathan Goosey and Martha his wife made Oath to 4 dayes attendance Each
of them for Mr. William Willkeson against John Boulton Ordered that Mr.
Willkeson pay them att thirty pounds of Tobacco Each of them a day.
John Burras and William Carter made Oath to three dayes attendance for
Mr. William Willkeson against John Boulton Ordered that Mr. Willkeson pay
them att thirty per day Each of them.
Thomas Colliar Plantiff: Brightwells administrators Defendants
Thomas Hollyday and Joshua Cecell of Prince Georges County Gentlemen
otherwise Called Thomas Hollyday and Joshua Cecell the administrators of
Richard Brightwell Late of Callvert County in the Province of Maryland Gen-
tleman Deceased was Sumoned to answer unto Thomas Colliar of the Same
County Inholder of a plea that they render unto him the full and Just Sume
of Sixteen hundred and Sixteen pounds of good Sound Merchantable Tobacco
and Caske which from him they unjustly deteine.
And whereupon the Said Thomas Colliar by John Meryton his Attorney com-
pleineth that whereas the Said Richard Brightwell the Seventh day of January
1693 [1694] in his life time Stood indebted unto the Said Thomas Colliar by his
certaine bill or wrighting obligatary Sealed with the Seal of the Said Richard
and here in Court produced whose Date is the Day and year aforesaid did binde
himselfe his heires Executors or administrators to pay or Cause to be paid unto
Thomas Colliar of the Same County Inholder his heirs Executors administrators
or assignes the Full and Just Sume of Sixteen hundred and Sixteen pounds of
good Sound [455] merchantable Leafe tobacco and Caske Convenient in
Patuxant River in the Said County att or upon the tenth day of October next
Ensueing the Date hereof Not withstanding which the Said Richard Brightwell
the Said Sume of Sixteen hundred and Sixteen pounds of Tobacco in his Life
time to the Said Thomas Colliar did not pay nor the Said Thomas Colliar nor
Joshua Cecell Since his Death to whom the Letters of administration hath been
Committed although often demanded but the Said Sume of Sixteen hundred
and Sixteen pounds of Tobacco to him the Said Thomas Colliar to pay the
Said Thomas and Joshua hitherto hath denyed and as yett doth denye where-
upon the Said Thomas Colliar Saith he is Damnifyed and hath Loss to the
value of 3200 pds of Tobacco and thereupon he brings his Suite.
