thirty and three pounds of good Sound Merchantable Leave Tobacco clear from
trash and Ground Leaves and Caske to Conteine the Same to be paid upon the
Plantation he the Said Phillip did then Live upon all demands after the tenth
day of October next [453] Ensueing the date of the Said bill obligatory Not-
withstanding which the Said Phillipp the Said Sume of 2333 lbs. of Tobacco
and Caske according to the tennor of the Said bill Obligatory allthough often
required the Same to the Said Richard in his Life time or to the Said Thomas
Since the Death of the Said Richard to whom Administration of the goods and
Chatties of the Said Richard after his death was Legally committed hath not
rendred but the Same to render to them hath denyed and the Same to the Said
Thomas as yett to render doth denye and unjustly deteine whereupon he Sayes
that he is Damnifyed and hath damage to the Value of 4000 lbs. of Tobacco
and thereupon he brings this Suite etc.

And the Said Thomas brings here into Court the Letters administration etc.
that it may the plainer appear etc. And the Said Phillip Trottershell in his
Propper person cometh and defendeth the force and Injury when etc. and prayeth
Lycence thereof to Imparle here untill the next Court Coming and it is granted
unto him the Same day is given to the Plantive Likewise.
Att which day (to witt) the 22d day of August Annoque Domini 1699 came
as well the Said Thomas Greenfeild administrator as aforesaid by his Attorney
aforesaid as allso the Said Phillip Trottershall Defendant in his propper person
and the Said Joshua Cecell prayeth that the Said Phillip Trottershall to his
Declaration aforesaid may answer.
Whereupon the Said Phillip Trottershell in his propper person comes and
defends the force and Injury when etc. and Saith that he ought not to be
Charged with the whole Debt because he made oath to a Certaine Part paid
thereof (as viz.)

Then came before us Phillip Tottersell and tooke his Oath upon the Holy
Evangelist that this account is Just and true and that he finds noe Credditt given
him by Mr. Charletts account for the Same.

Therefore it is Considered that the Said Thomas Greenfeild administrator
as aforesaid Plantife recover against the Said Phillip Tottershell Defendant
onely nine hundred thirty and three pounds of Tobacco the ballance of the
bill Sued for as allso the Sume of three hundred twenty four pounds of Tobacco
to the Said plantiffe of his assent by the Court here adjudged and the Said
Phillip Trottershell Defendant in Mercy.

John Boulton Late of Prince Georges County planter was atteached to answer
unto William Willkinson of a Plea of Trespass upon the Case etc.
And whereupon the Said William Willkinson by Joshua Cecell his Attorney
Compleineth that whereas the Said William upon or about the tenth day of
