fendeth the force and Injury when etc. and Saith that hee cannot gainesay the
Action of the Said Kathrine Willson and Joshua Cecell nor but the three
hundred fifety three pounds of Tobacco is due and oweing to the Said Jonathan
Willson Deceased in manner and forme as abovesaid and Desiered that Judg-
ment might be entred against him for the Same.

Therefore it is Considered that the Said Kathrine Willson and Joshua Cecell
recover against the Said Mareen Devall the Sume of three hundred fifty and
three pounds of Tobacco their Debt aforesaid and their Damages by Occation of
Deteineing the Said Debt to pounds of Tobacco to the Said Kathrine
Willson and Joshua Cecell of their assents by the Court adjudged and the Said
Mareen Devall in mercy.

[434] Jonathan Willsons Executors: Plantiffs: John Mills Defendant

The Plantiffs in their Propper Persons brought his Majesties writt of Capias
against the Defendant in a Plea of Tresspass upon the Case etc. it being for two
hundred Ninety and Eight pounds of Tobacco as by Declaration filed and
accompt here Entred may appear.

Whereupon the Said John Mills in his Propper person cometh and Defendeth
the force and Injury when etc. and Saith that hee cannot gainsay the action of
