JUNE, 1699 COURT 503

Death of the Said Jonathan to whom Execution of the Last will and Testament
of the Said Jonathan after his Discease was Legally Committed hath not paid
but the Same to pay they have denyed and Still doth denye to the Damage
of the Said Kathrine and Joshua of 1000 pounds of Tobacco and thereupon
they bring this Suite etc. and they bring into Court here the Letters Testa-
mentary and that it may the pleiner appear etc.
Joshua Cecell pledges to procecute John Doe, Richard Roe
Whereupon the Said John Hill and Sarah his wife administratrix as above-
said cometh in their proper persons and defendeth the force and Injury when
etc. and Saith that they cannot gainesay the action of the Said Kathrine and
Joshua Nor but the 741 pounds of Tobacco is Due and oweing to the Said
Willsons Executors in Manner and forme as the Said Kathrine Willson and
Joshua Cecell against them hath Declared.

Therefore it is considered that the Said Kathrine Willson and Joshua Cecell
recover against the Said John Hill the Sume Seven hundred forty one pounds
of Tobacco their Debt aforesaid and their Damages by Occation of Deteineing
the Said Debt to pounds of Tobacco to the Said Kathrine Willson and
Joshua Cecell of their assent by the Court here adjudged and the Said John
Hill in mercy.

William Herbert made Oath to an account against Jonathan Willson Deceased.

Nathaniell Wickham made oath to 4 dayes attendance for John Cousens
against John Ramsey Ordered that the Said John Cousens pay the Said Wick-
ham one hundred and twenty pounds of Tobacco for his Said attendance.

Then did the Court adjourne till tomorrow morning 7 of the Clock.

[433] Present. Mr. Thomas Hollyday, Mr. Robert Bradley, Mr. Robert Tyler,
Mr. Robert Wade, Mr. John Hawkins, Mr. Samuell Magruder, Mr. Thomas
Sprigg, Comissioners.

Jonathan Willsons Executors: Plantiffs: Joseph Winger Defendant

The Plantiffs in their Propper persons brought his Majesties writt of Capias
against the Defendant in a Plea of Tresspass upon the Case etc. it being for
Seven hundred and tenn pounds of Tobacco as by Declaration filed and account
here Entred may appear.
