476 PRINCE GEORGES COUNTY

refused and Still doth refuse to the damage of the Said John of 800 pounds of
Tobacco and thereof he bringeth his Suite etc.

William Stone John Doe, Richard Roe. pledges etc.

Whereupon the Said Matthew Mackeboy by Joshua Cecell his Attorney comes
and defends the force and Injury when etc. and prayeth Lycence thereof to im-
parle here untill the next Court and it is Granted unto him the Same day is
Given to the Plantiffe likewise.

And now here att this day (to witt) the 28th day of March Annoque Domini
1699 came here as well the Said John Underwood as the Said Matthew Mackeboy
by their Attorneyes aforesaid and the Said John Underwood by his attorney
aforesaid prayeth that the Said Matthew Makeboy to his declaration aforesaid
may answer.

Whereupon the Said Matthew Mackeboy by his Attorney aforesaid cometh and
defendeth the force and Injury when etc. and Saith that hee did not assume in
Manner and forme and of this he putts himselfe upon the Country. Joshua
Cecell. And the Plantiff allso William Stone.

Therefore it is Commanded the Sheriff that without delay he cause to come
here twelve, etc. by whom etc. and who neither etc. to recognize etc. because as
well etc. and now here att this day that is to Say the Said the 28th day of March
came as well the Said John Underwood as the Said Matthew Mackeboy by their
Attorneyes aforesaid and the Jurors thereon impanelled being Called Likewise
came (Viz.)

James Stoddart, foreman, Richard Gambra, James Brooke, William Lintall,

Joshua Browne, Charles Wallker, Archibald Edmundson, Charles Beall, John

Davis, John Downton, William Gaskin, William Stimpson.

Who to Speake the truth concerning the premisses being Elected tryed and
Sworne upon their oaths doe Say that the Said defendant doth not owe the
Said Plantiffe the Said four hundred pounds of Tobacco as the Plantiffe above in
the plea aforesaid hath alleadged.

Therefore it is Considered that the Said John Underwood take nothing by his
Said writt but bee in Mercy for his Falce Clammor and that the Said Matthew
Mackeboy goe thereof without day. It is Likewise Considered that the Said
Matthew Mackeboy recover against the Said John Underwood his damages by
Occation of the Premisses to [pounds] of Tobacco to the Said Matthew
Mackeboy by the Discression of the Justices here att his request for his Cost and
Charges in his behalfe Susteined according to the forme of the Statute etc. by the
Court here adjudged.

James Watts Plantiff: Daniell Hurle Defendant

The Plantiffe by Joshua Cecell his attorney brought his Majesties writt against
the Defendant in a plea of tresspass upon the Case etc. being for one thousand
twenty Seven pounds of Tobacco due by account as by Declaration filed and
account here Entred may appear, etc.
