438 PRINCE GEORGES COUNTY

William Phillmore Plantiff: Ninian Beall Deffendant

William Phillmore who brought the writt of Our Sovereigne Lord the King
against Ninian Beeall of a Plea of Tresspass upon the Case etc. and hath not
prosecuted his Said writt Therefore hee and his Pledgis bee in Mercy Lett the
names of the Pledges bee Sought etc. and the Said Ninian Beall goe thereof with-
out Day etc. it is Likewise Considered that the Said Ninian Beall recover against
the Said William Phillmore his Damages by Occation of the Premises to two
hundred Sixty five pounds of Tobacco to the Said Ninian Beall by the Discression
of the Justices here att his request for his Cost and Charges in this behalfe Sus-
teined according to the forme of the Statute etc. by the Court here adjudged.

Simon Nicholls Plantiffs: Jonathan Willsons Executors Defendant
Simon Nicholls who brought the writt of our Sovereigne Lord the King against
Kathrine Willson and Joshua Cecell Executors of the Last Will and testament of
Jonathan Willson Disceased of a Plea of Tresspass upon the case etc. and hath not
prosecuted his Said Writt etc. Therefore hee and his Pledges of Prosecuteing be in
mercy etc. Lett the names of the Pledges be Sought etc. and the Said Kathrin
Willson and Joshua Cecell goe thereof without Day etc. it is Likewise Considered
that the Said Kathrine Willson and Joshua Cecell recover against the Said Simon
Nicholls their Damages by Occation of the Premises to three Hundred and Seven
Pownds of Tobacco to the Said Kathrine Willson and Joshua Cecell by the Dis-
cression of the Justices here att their request for their Cost and Charges in this
behalfe Susteined according to the Forme of the Statute etc. by the Court here
adjudged.

Henry Willis Plantiffe Treacys Administrator Defendant

Henry Willis who brought the writt of our Sovereigne Lord the King against
David Small Administrator of all the Goods Chatties and Credditts of Charles
Treacy Disceased of a Plea of tresspass upon the Case etc. and hath not Prose-
cuted his Said writt, Therefore hee and his Pledges of Prosecuting bee in mercy
etc. Lett the names of the Pledges be Sought etc. and the Said David Small goe
thereof without day etc. it is likewise Considered that the Said David Small
recover against the Said Henry Willis his Damages by occation of the Premises
to two Hundred Sixty five pounds of Tobacco to the Said David Small by the
Discression of the Justices here att his request for his Cost and Charges in this
behalfe Susteined according to the forme of the Statute etc. by the Court here
adjudged.

James Brooke Plantiff: Treacys Administrator Defendant

It is Commanded the Sheriffe that there is Due to James Brooke from David
Small Administrator of all and Singular the Goods Chatties and Creditt of
Charles Treacy Deceased the Sume of five Thousand two Hundred pounds of
Tobacco by a Judgement obteind against the Said Charles Treacy in March
Court in the year 1697 and for Execution hath not Ishued forth against the
Said Charles Treacy in his Life time for the Same nor against the Said David
Small administrator as above Said hee make Knowne to the Said [388] David
Small that he bee and appear before the Justices of Prince Georges County
Court att Charles Towne the 4th Tuesday in November 1698 to Shew Cause etc.
if any he have why the Said James Brooke Executor for the Debt aforesaid
Should not have etc. and that he had then and there the Said writt etc.
