NOVEMBER, 1698 COURT 415

as afforesaid Should not be Condemned and Execution thereon to be had and
made etc.

Att which Said day the Said Sheriff came into Court and made returne of the
Said writt Endorsed on the back of the Said writt as Followeth (Viz.) atteached
in the hands of Thomas Swaringam three Hundred pounds of Tobacco.

Sumoned per Thomas Greenfeild Sheriff.

Att which day came the Said Thomas Swaringam into Court and made oath
that he had none of the Goods Chattells or Credditts nor any of the Esteat of the
Said David Ambross' in his hands. Therefore tis Considered that the aforesaid
atteachment be Voyd and of none Effect and the Said Thomas Swareingam goe
thereof without Day etc. by the Court here adjudged.

Joseph Addison Plantiffe: William Groome Defendant

William Groome Late of Prince Georges County Inholder was atteached to
answer unto Joseph Addison of a Plea that he hold Covenant with him according
to the forme and Effect of a certaine wrighting betweene them made And where-
upon the Said Joseph Addison by William Bleden his attorney Saith that wheras
the Said William Groom by a certaine wrighting made the fifeteen day of January
in the year of our Lord 1696/7 att Charles Towne within the Jurisdiction of
this Court between the Said William Groome of the one part and the Said Joseph
Addison of the other part which Said wrighting with the Seal of the Said William
Groome Signed he the Said Joseph Addison here in Court produceth the date
whereof is the day and year afforesaid Wittnesseth (viz.) that the Said Joseph
had thereby taken the Plantation of the Said William Groome which he the Said
William did then Live on lying near Charles Towne in Prince Georges County
for the terme of four years from the date of these presents, to make Cropps of
Corne and Tobacco upon, and what hands the Said William could put along with
the Said Joseph upon the Said Plantation the Said Joseph to doe his uttmost
Endevour in makeing a Cropp of Corne and Tobacco or any thing elce upon the
Said plantation the Said Joseph to Lead the Said Hands out and in and to Labour
with the Said hands of the Said Groome the Said Hands not to Exceed four and
the Said Joseph to allow the Said William an equall Share of Corne and Tobacco
or any thing Elce made upon the plantation afforesaid that is to Say every hand
an equall Share, the Said Joseph to doe his uttmost Endevour to raise a Stock of
Cattle and Hoggs upon the Said Plantation for the Said William the Said William
findeing corne for the Same the Said Joseph to Plant out two Hundred aple trees
and to keep good Sufficient fence about the Said trees and to plant or tend Corne
or tobacco among them, the Said William findeing the Said trees to Plant the
Said Joseph to repair and make what Fenceing is Convenient upon the Said Plan-
tation and to make good pasture Fence Sufficient to Keep horses in att Court time,
the Said William findeing and providing Railes Mauled to performe the Same and
the Said William in Consideration of the Said Josephs workeing and lookeing
aftar the Said Hands aforesaid doth find the Said Joseph accomadations and pay
for his the Said Josephs Caske and Leavie and that he the Said Joseph have an
equall Share of Corne Tobacco Beanes or any thing Elce is made upon the Said
plantation the Said William to Lay in Provision for the Said Joseph (viz.) three
Barrells of Indian Corne and two Hundred weight of meal and the [Said] William
to allow the Said Josephs wife ground to make a Hogshead of Tobacco upon the
Said Plantation And what hands the Said William putts upon the Said plantation
is to be put on between the [371] Fall and the Last of February year by year
