would well and truly Content and pay Nevertheless the Said Joseph his promise
and Assumption Soe as aforesaid made Little Regarding but minding and
Fraudulently Intending him the Said Francis in this behalfe Craftily and
Subtilly to Deceive and defraud the Said Sume of 500 lbs. of tobaccoe or any
part thereof to the Said Francis hath not paid Although the Said Joseph to
doe the Same by the Said Francis afterwards the day and place aforesaid was
often thereunto Requested but the Same to pay to the Said Francis hath hitherto
Refused and Still doth Refuse to the Damage of the Said Francis of 1000 lbs.
of tobaccoe and thereupon he brings this Suite etc.

The plantiffe by his Attorney aforesaid haveing Issued out a writt against
the Defendant which Said writt was by the Sheriffe Returned that the Said
Defendant was not to be found in his balywick and Likewise have Caused a
Coppy of the above Declaration and Account to be Left at the house where the
Defendant Last Lived in this County It is Likewise testified on part of the
Said plantiffe here in Court that the Said Defendant hath Elloined himselfe out
of the Jurisdiction of this Court Whereupon the Said Francis Hackett by his
Attorney aforesaid prayeth an Attachment against the goods Chatties and
Creditts of the Said Joseph Letchworth as well for the Said Sume of five
hundred lbs. of tobacco aforesaid as alsoe the Sume of four hundred and Six lbs.
of tobaccoe his Cost and Charges in this behalfe Laid out and Expended And by
the Court here it is granted unto him etc.

John Hume plantiffe: James Henry Defendant

The plantiffe by William Stone his Attorney Sues the Defendant in a plea of
trespass upon the Case for five hundred and thirty pounds of tobaccoe due by
Account as by Decleration filed and Account here Sett downe Appeareth (Viz.)

James Henry Debtor to John Hume January the 25th 1695/6

To 1 hogshead of Syder att 480, to 5 gallons of Ditto att: 50 ................ 530

Aug. the 25th 1697: Then Came John Hume before us and made oath that
the above Account is Just and true and that he never Received part nor parcell
thereof.

Whereupon the Said plantiffe by his Attorney aforesaid haveing Issued out a
writt against the Defendant and Likewise have Caused a Coppy of the Declera-
tion to be Left with the Defendant by the Sheriffe att the time of Serving the
Said writt which was Eight dayes before this Court prayeth that the Said De-
fendant to his Decleration aforesaid this Court may Answer According to an Act
of [323] Assembly in Such Cases made and provided etc. Whereupon James
Henry by John Meriton his Attorney Cometh and Defendeth the force and
Injury when etc. And Saith that hee is not informed by the Said James Henry
