Thomas Nellson plantiffe: Thomas Greenfeild Administrator of Richard
Charlett Defendant
The plantiffe by William Bladen his Attorney brought his Majesties writt
against the Defendant in a plea of trespass upon the Case etc. And hath not
procecuted his Said writt etc. therefore he and his pledges of procecuteing by
in mercy etc. Lett the names of the pledges be Sought etc. And the Said Thomas
Greenfeild goe thereof without Day etc. It is Likewise Considered that the Said
Thomas Greenfeild Recover against the Said Thomas Nellson his Damages by
Occation of the premises to two hundred Sixty five pounds of tobaccoe to the
Said Thomas Greenfeild by the discretion of the Justices here at his Request for
his Costs and Charges in this behalfe Sustained According to the forme of the
Statute etc. by the Court here Adjudged etc.
Edward Batson plantiffe: John Mills Defendant
It was Commanded the Sheriffe that whereas Edward Batson Lately in the
Court of our Sovereigne Lord the King now here that is to Say at a Court held
the 25th day of August 1696 before the Justices of our Sovereigne Lord the King
here by Consideration of the Justices of the Said Court had Recovered against
John Mills Late of etc. as well a Certaine Debt of four [313] hundred pounds
of tobaccoe as two hundred and Sixteen pounds of tobaccoe to the Said Edward
Batson in the Same Court Were Adjudged for his damages which hee had by
Occation of Deteyning of the Said Debt whereof hee was Convicted as by the
Records and process thereof in our Said Court Remaining manyfestly Appeareth
Nevertheless Execution of the Judgment aforesaid yett Remaineth to be done
as by the Insinuation of the Said Edward Batson our Sovereigne Lord the King
is given to understand and because etc. that by Law etc. hee make knowne to
the Said John Mills that he be here at the 25th day of January Annoque Domini
1697[1698] to Shew Cause if etc. wherefore the Said Edward Batson his Execu-
tion against him of the Debt and Damages aforesaid ought not to have Accord-
ing to the Recovery aforesaid if etc.
And the Said John Mills in his proper person Came and defendeth the force
and Injury when etc. and Craveth Lycence thereof to Imparle here untill next
Court and it is granted unto him the Same day is given to the plantiffe Like-
wise etc. And now here att this day (to witt) the 22d day of March 1697[1698]
Came here as well the Said Edward Battson as the Said John Mills in their
proper person and the Said Edward Batson prayeth that the Said John Mills
to his writt of Sciry facias aforesaid may Answer etc.
The truth of the matter in Controversie between the parties aforesaid by the
Court here being Seen heard understood and Maturely Deliberated it is there-
upon Considered that the Said Edward Batson take nothing by his Said writt
of Scire facias aforesaid but be in mercy for his false Clammor etc. And that
the Said John Mills goe thereof without day etc. It is Likewise Considered that
the Said John Mills Recover against the Said Edward Batson his Damages by
Occatione of the premises to one hundred and five pounds of tobaccoe to the
Said John Mills by the discretion of the Justices here at his Request for his
Costs and Charges in this behalfe Sustained According to the forme of the
Statute etc. by the Court here Adjudged etc.
