Hugh Ryley plantiffe: Nicholas Sawell Defendant

Prince Georges County Ss. Nicholas Sawell Late of Prince Georges County
Gentleman was Attached to Answer unto Hugh Ryley of a plea of trespass upon
the Case etc.

And Whereupon the Said Hugh by William Stone his Attorney Complaineth
that whereas the Said Nicholas the 23d day of March in the yeare of our Lord
1697 [1698] at Charles Towne within the Jurisdiction of this Court was Indebted
unto the Said Hugh in the Sume of one thowsand Eight hundred and tenn pounds
of tobaccoe being Soe much due to the Said Hugh from the Said Nicholas upon the
ballance of Accounts between him the Said Hugh and the Said Nicholas as by a
[291] Pertickeler Account thereof here Ready in Court to be produced Relation
thereunto being had more plainly and at Large may Appeare and the Said
Nicholas to the Said Hugh being Soe indebted as aforesaid Inconsideration
thereof did Assume upon himselfe and to the Said Hugh then and there faithfully
promise that he the Said Sume of 1810 lbs. of tobaccoe to him the Said Hugh
when he Should be thereunto Requested would well and truly Content and pay
Nevertheless the Said Nicholas his promise and Assumption aforesaid not at all
Regarding but minding and Fraudulently Intending him the Said Hugh in this
behalf e Craftily and Subtilly to deceive and Defraud the Said Sume of 1810 lbs.
of tobaccoe to the Said Hugh hath not paid Altho the Said Nicholas to doe the
Same by the Said Hugh Afterwards the day and place aforesaid and Severall other
dayes and times was Often thereunto Requested but hath hitherto Refused and
Still doth Refuse to the Damage of the Said Hugh of 2500 lbs. pounds of tobaccoe
and thereof he bringeth his Suite etc.

March the 23d 1696 [1697].

Then Came Hugh Ryley in open Court and made oath that the above is a true
and Just Account and that he hath not Received any part or parcell thereof more
then what he hath given Creditt for. Joshua Cecell Clerke.

Sept. 1697: Then Demanded the above ballance of Major Nicholas Sewall in
behalfe of the Said Hugh Riley and the Major for Answer Says he must take his
Course. Thomas Greenfeld.

And the Said Nicholas Sawell by William Bladen his Attorney Cometh and
defendeth the force and Injury when etc. And Craveth Lycence thereof to Imparle
here untill next Court and it is granted unto him the Same day is given to the
plantiffe Likewise. At which Said next Court (to witt) the 25th day of January
Annoque Domini 1697 [1698] Came as well the Said Hugh Ryley as the Said
Nicholas Sewall by their Attorneys aforesaid and the Said Hugh Ryley prayeth
