310 PRINCE GEORGES COUNTY

Therefore it is Considered that the Said Allexander Chappie take nothing by
his Said writt but be in mercy for his false Clammor and that the Said John
Deakins goe thereof without day etc. It is Likewise Considered that the Said
John Deakins Recover against the Said Allexander Chappie his Damages by
Occation of the premises to Eleven hundred forty one pounds of tobaccoe to the
Said John Deakins by the Discretion of the Justices here at his Request for his
Costs and Charges in this behalfe Sustained According to the forme of the
Stattute etc. by the Court here Adjudged etc.

Henry Truemans Administrator plantiffe: John Davis Defendant
Thomas Taney and Jane his wife Administratrix of the goods Chatties and
Creditts of Henry Trueman Late of Calvert County Deceased brought his
Majesties writt against John Davis Late of Prince Georges County otherwise
Called John Davis of Calvert County in the province of Maryland planter in a
plea of Debt for the full and Just Sume of one thowsand one hundred and
twenty Eight pounds of good Sound Merchantable Leafe tobaccoe and Caske
which from them he unjustly Deteyneth etc. as by Declaration filed and bill
filed bearing date the twenty Second day of March Annoque Domini 1694/5.
And the Said John Davis by William Stone his Attorney Cometh and Defendeth
the force and Injury when etc. and prayeth Lycence of the Court here to Imparle
untill the next Court and it is granted unto him the Same day is given unto
the plantiff Likewise. And now here at this day (to witt) the 25th day of
January in the year of our Lord 1697 [1698] Came as well the Said Thomas
and Jane Administratrix aforesaid by William Bladen their Attorney as the Said
John Davis by his Attorney aforesaid and the Said Thomas and Jane by their
Attorney aforesaid prayeth that the Said John Davis to theire Decleration afore-
said may Answer etc. Whereupon the Said John Davis by William Stone his
Attorney Cometh and defendeth the force and Injury when etc. and for plea
Saith that he hath well and truly paid the Said Sume of one thowsand one
hundred and twenty Eight pounds of tobaccoe in the Decleration mentioned
and Expressed and of this he putts himselfe upon the Court. William
Stone. And the plantiffes Alsoe. William Bladen.

The truth of the matter in Controversie between the parties aforesaid by the
Court here being Seen heard understood and Maturely deliberated It is there-
upon Considered that the Said Thomas Taney and Jane his wife Administratrix
aforesaid Recover against the Said John Davis the Sume of one thowsand one
hundred and twenty Eight lbs. of tobaccoe the Debt aforesaid and their
Damages by Occation of Deteyning the Said Debt two hundred Sixty Eight lbs.
of tobaccoe to the Said Thomas and Jane of their Assent by the Court here
Adjudged And the Said John Davis in mercy etc.

[285] Richard Jones plantiffe: Matthew Mockeboy Defendant.

Richard Jones by James Cranford his Attorney brought his Majesties writt
against Matthew Mockeboy of a plea of trespass upon the Case etc. And hath
not procecuted his Said writt etc. Therefore he and his pledges of procecuteing
be in mercy etc. Lett the Names of the pledges be Sought etc. And the Said
Matthew Mockeboy goe thereof without Day etc. It is Likewise Considered that
the Said Matthew Mockeboy Recover against the Said Richard Jones his damages
by Occation of the premises to two hundred Seventy Seven pounds of tobaccoe
to the Said Matthew Mockeboy by the discretion of the Justices here at his
