298 PRINCE GEORGES COUNTY

Said William Phillmore and that the Said Joshua Cecell have Execution against
the Said William Philmore of the Said 1108 pounds of tobaccoe Soe as aforesaid
in his hands Attached etc.

Henry Jowles against John Davis

It was Commanded the Sheriffe that whereas there is due from John Davis
unto Col. Henry Jowles Six hundred twenty Eight pounds of tobaccoe for Clerks
fees in Calvert County and for which Execution hath not yet been Served he
make knowne to the Said John Davis that he Appeare before the Justices of
Prince Georges County Court at Charles Towne the fourth Tuesday in January
1697 [1698] to Shew Cause if etc. why the Said Henry Jowles Execution for his
Debt aforesaid Should not have etc. And that he had then [274] And there
the Said writt etc. As by an Account filed may more at Large Appeare etc. And
now here at this day Came the Said Henry Jowles in his owne person and offered
himselfe against the Said John Davis of the plea aforesaid And he being Solemly
Called Likewise Came etc.

And the Sheriffe now Returneth that he hath by Lawfull men etc. made
knowne unto the Said John Davis of his being here this day to Shew Cause in
forme aforesaid etc. The truth of the matter between the parties aforesaid by
the Court here being Seen heard and understood It is Considered that the Said
Henry Jowles have Execution against the Said John Davis of his Debt aforesaid
together with one hundred pounds of tobaccoe for his Cost and Charges in this
behalfe Sustained etc.

George Plowden against Richard Marsham and his wife Administratrix Brent

George Plowden brought his Majesties writt against Richard Marsham and
Ann his wife Administratrix of all and Singular the goods Chatties and Cred-
itts which were of Henry Brent Late of Calvert County gentleman Deceased of a
plea of trespass upon the Case etc.

And now here at this day to witt the 25th Day of January in the yeare of our
Lord 1697 [1698] Cane the Sheriffe And Returned the Said writt (Endorsed on
the back) Cepi per Thomas Greenfeild Sheriffe.

And the Said Richard Marsham and Ann his wife in there proper person
Cometh here into Court and defendeth the Force and Injury when etc. And
Alledged that they had An Account against the Said George Plowden Due to
the Said Deceased and therefore prayeth that Auditors may be Assigned them
to heare and Adjust Accounts between the Said parties Whereupon Auditors are
Assigned them (Viz.) Mr. David Small and Mr. James Moore who was ordered
by the Court here to Audite State and Adjust the Accounts between the Said
parties and to make Report thereof Some time dureing the Courts Sitting etc.

And now here this Court to witt the 26th day of January 1697 [1698]: Came
as well the Said George Plowden by William Stone his Attorney as the Said
Richard and Ann in theire proper persons and the Auditors Assigned as afore-
said Likewise Came and made Report as followeth (Viz.)

January the 26th 1697/8

Then Accounts made up betwixt Mr. George Plowden and Mr. Richard
Marsham and the ballance wee find due to Mr. Marsham from the Said Plowden
being on the Account of the Estate of Mr. Henry Brent Deceased the neate
quantity of Six thowsand four hundred forty and two pounds of tobaccoe And
