time being to Signe a pass to any Such person or persons to depart this province
for which pass the party Shall pay to the person Signing the Same the Sume of
two Shillings Six pence Sterling and if any person or persons upon any Suddaine
or Emergent Occation are necessiated to depart this province not haveing Sett
up his or theire name or names At the Secretaryes office aforesaid then Such
person or persons giving good Sufficient Security to the Governor Keeper of the
Great Scale or Secretary to discharge and pay all Debts and Accounts whatsoever
due and owing from the Said persons to any of the Inhabitants then the Said
person or persons Soe departing may have a pass as aforesaid (And in the Said
Act it was further Enacted) that any Master of Shipps or Vessells or other persons
whatsoever that Shall transport or Convey out of this province by Land or water
any Freeman being Endebted by bond bill or Account or otherwise to any In-
habitants thereof without Such pass under the hand of the Governor Chancellor
or Secretary aforesaid Shall bee Liable to Sattisfie all Such debts Engagements
and Damages to the person or persons to whome Such Debt or Damages Respec-
tively Shall be due within this province Except the Same be otherwise Sattisfied
or that the transporter or Conveyour away of Such person or persons procure
Such person or persons to Returne againe in one month after whereby he may be
Lyable to Justice here as by the Said Act Relation being thereunto had more
at Large may Appeare. Notwithstanding which the Said John Garrett the Said
Act of Assembly well knowing and the penalltyes therein Contained but not at
all Regarding nor on[e] Jott Feareing the Same but in Contempt and dispight
thereof after the [215] Makeing of the Said Act of Assembly (to witt) about
the 10th day of December in the year of our Lord 1696 Att Potomock River that
is to Say att Charles Towne within the Jurisdiction of this Court did transport
and Convey in a boate of his the Said John Garrett over the Said Potomock River
into Virginia one Daniell Troy not haveing any pass as aforesaid Lately a Free-
man and a dweller in this County of Prince George which Said Daniell Troy at
the time of his departure out of this County of Prince George and at the time
aforesaid that the Said John Garrett did transport and Convey the Said Daniell
Troy in his the Said John Garretts boate over Potomock River into Virginia did
Stand Justly Indebted unto the Said Charles Tracey in the Sume of three thow-
sand nine hundred thirty four lbs. of tobaccoe being Soe much tobaccoe due from
the Said Daniell Troy unto the Said Charles Tracey upon the ballance of Account
for divers goods Accomedations and Ordinary Expences by the Said Charles
Tracey Sold and Delivered the Said Daniell Troy at Severall times and dayes
between the 4th day of Sept 1696 and the 21th day of November in the year of our
Lord 1696 As by A pertickeler Account thereof here in Court produced Relation
being thereunto had may more at Large Appeare and Soe the Said Charles
Tracey the Said Sume of 3934 lbs. of tobaccoe due to him from the Said Daniell
Troy upon the ballance of Account as aforesaid by means of the Said John
Garrett transporting and Conveying the Said Daniel Troy over Potomock River
into Virginia as aforesaid hath utterly Lost as to any Recovery against the Said
Daniell Troy or any otherwise Excepting by force of the Said Act of Assembly
against the Said John Garrett In Contempt and dispight of which Said Act of
Assembly the Said John Garrett the Said Daniell Troy did transport and Convey
over Potomock River into Virginia in a boate of his the Said John Garrett as
aforesaid by which Action to the Said Charles Tracey doth Accrue to have and
Requier of the Said John Garrett the Said Sume of 3934 lbs. of tobaccoe Yett the
Said John Garrett the Said Sume of 3934 lbs of tobaccoe to him the Said Charles
Tracey Although Often thereunto Required hath not Rendered nor any Sattis-
