Said Sume of three pounds Sterling mony of England to the Said John Under-
wood hath denyed to pay and Still doth Denye to the Damage of the Said John
Underwood of Six pounds Sterling and thereupon he brings this Suite etc.

The plantiffe by his Attorney aforesaid haveing Issued out a writt against the
Said Defendant which Said writt was by the Sherife Returned that the Said
Defendant was not to be found in his Balywick and alsoe have Caused a Coppy
of the Decleration to be Left at the house were the Defendant last lived in
this County and Likewise it is testified here in Court on the behalfe of the
plantiffe that the Said Defendant is a forriner and is gone to England. Where-
upon the Said John Underwood by William Stone his Attorney prayeth an
Attachment against the goods Chatties and Creditts of the Said John Worster
as well for the Sume of three pounds Sterling mony of England aforesaid as
alsoe for the Sume of four hundred fifty five pounds of tobaccoe his Cost and
Charges in this behalfe laid out and Expended And by the Court here it is
granted unto him etc.

planter was Attached to Answer unto Peter Paggen and Company of a plea of
trespass upon the Case etc.
[173] And whereupon the Said Peter and Company by William Stone their
Attorney Complaineth that whereas the Said John the 20th day of August in the
yeare of our Lord 1696 att Charles Towne within the Jurisdiction of this Court
Stood Indebted unto the Said Peter and Company in the Sume of Eighteen
hundred thirty Seven pounds of tobaccoe being for Severall goods wares and
Merchandizes by the Said Peter and Company. Sould and delivered to the Said
John as by a pertickeler Account thereof here in Court produced Relation being
thereunto had more At Large may Appeare And the Said John to the Said
Peter and Company in manner aforesaid being Indebted Inconsideration thereof
the Said John did Assume upon himselfe and to the Said Peter and Company
then and there faithfully promise that he the Said John the Said Sume of 1837
pounds of tobaccoe when he Should be by the Said Peter and Company there-
unto Requested would well and Truly Content and pay Nevertheless the Said
John his promise and Assumption Soe as aforesaid made Little Regarding but
minding and fraudulently intending them the Said Peter and Company in this
behalfe Craftily and Subtilly to Deceive and Defraud the Said Sume of 1837 lbs.
of tobaccoe or any part thereof to the Said Peter and Company hath not paid
Although the Said John to doe the Same by the Said Peter and Company the
day and place aforesaid was often thereunto Requested but the Same to pay to
the Said Peter and Company hath hitherto denyed and Still doth deny to the
Damage of the Said Peter and Company of 3000 pounds of tobaccoe and there-
upon they bring this Suite etc.
