Said Charles at his Request being Indebted in the Sume of Six pounds Sterling
According to the use of Merchants delivered to the Said William three bills
of Exchange that is to Say First Second and third all of one tenner and date with
the proper hand of the Said Charles Subscribed and to Mr. Ralph Barrow att
Capt. Langleys in Nightingall Lane Limehouse derected in the first of which
bills the Said Charles did Requier the Said Ralph Barrow to pay unto the Said
William or his order the Sume of Six pounds Sterling Lawfull money of England
Att twenty dayes Sight after the Said first bill of Exchange the Second and
third of the Same tennor and date not being paid and in the Said Second bill
of Exchange the Said Charles did Likewise Requier the Said Ralph Barrow to
pay unto the Said William or order the Said Sume of Six pounds Sterling
lawfull money of England at twenty dayes after Sight of the Said Second bill
of Exchainge the first and third of the Same tennor and date not being paid and
Likewise in the Said third bill of Exchange the Said Charles did Requier
the Said Ralph Barrow to pay unto the Said William or order the Sume of
Six pounds Sterling lawfull money of England at twenty dayes after Sight of the
Said third bill of Exchange the firs[t] and Second not being paid and the Said
Charles afterwards the day and place aforesaid Inconsideration of the premises
did Assume upon himselfe and to the Said William then and there Faithfully
promise that if the Said Ralph Barrow the Said bills of Exchange or any one of
them did not Accept and pay to the Said William or his order According to the
tennor of the Said bills that hee the Said Charles when after the Said twenty
dayes mentioned in the Said bills Should be required the Said Sume of Six pounds
Sterling Lawfull money of England to the Said William would well and truly
Content and pay and the Said William Herbert in fact Saith that Afterwards
that is to Say the 21th day of November in the year of our Lord 1694 aforesaid
att London the Said William by his Appointment and order did Show and offer
the Second of the Said bill of Exchange the first and third not being paid Accord-
ing to the tennor of the Said bill and that the Said Ralph Barrow did not Accept
or pay the Same According to the Contents thereof wherefore the Said William
the Said bill of Exchange Soe Shewed and tendered and Refused to be paid
Afterwards the day and place Last mentioned by Nicholas Haywood Notary and
tabellion publick dwelling in London in due forme of Law According to the use
of Marchants did protest as by the Same protest here ready in Court to be pro-
duced more at large may Appeare And afterwards that is to Say the 20th day of
October in the yeare of our Lord 1696 being after the End of the Said twenty
dayes aforesaid mentioned in the Said bills the Said William to the Said Charles
did give notice that the Said bills of Exchange weare nott Accepted nor paid by
the Said Ralph Barrow According to the Contents thereof and thereon in usuall
manner According to the use of Marchants protested Nevertheless the Said
Charles his promise and Assumption aforesaid [134] Nott Regarding but
minding and Fradulently Intending him the Said William in this behalfe
Craftily and Subtilly to deceave and defraud the Said Sume of Six pounds
Sterling Lawfull money of England to the Said William hath not paid Although
the Said Charles to doe the Same by the Said William the day and place Last
mentioned was Requested but hath hitherto Refused and Still doth Refuse to the
Damage of the Said William of 12 pounds Sterling and thereof he bringeth his
Suite etc.
