and defraud the Said Sume of 510 lbs. of tobaccoe nor any part thereof to the
Said Richard hath not paid but the Same to pay hath denyed and Still doth
deny to the plantiffs Damage 1000 lbs. tobaccoe and thereupon he brings his Suite.

September the 26: 1696: Then Came Richard Kilburne before me Thomas
Tasker one of his Majestys Justices of the Provintiall Court and made oath
that the above Account is a true and Just Account and that he hath Received
no part nor parcell thereof.

Jurat Coram me. Thomas Tasker.

And the Said Allexander Herbert in his proper person Cometh and defencleth
the force and Injury when etc. And Craveth Liberty to Imparle here untill the
next Court and it is granted unto him the Same Day is given to the plantiffe
Likewise.

Att which Said next Court (to witt) the 26th day of January Annoque
Domini 1696 [1697] Came the Said Richard Kilburne in his proper person and
prayeth that the Said Allexander [131] Herbert to his Decleration aforesaid
may Answer etc. But the Said Allexander Herbert Either by himself or Attorney
Although Sollemly Called Came not but made Default.

Therefore it is Considered that the Said Richard Kilburne Recover against
the Said Allexander Herbert as well the Sume of five hundred and tenn
pounds of tobaccoe his debt for damages due as aforesaid as alsoe the Sume of
two hundred and Sixteen pounds of tobaccoe to the Said Richard Kilburne of
his Assent by the Court here Adjudged etc. And the Same Allexander Herbert
in mercy etc.

William Young plantiffe: Charles Hay Defendant.

Prince Georges County Ss. Charles Hay late of Prince Georges County
planter otherwise Called Charles Hay of Calvert County in Maryland was
Sumoned to Answer unto William Young of a plea that he Render unto him
the full whole and Just Sume of four thowsand Seaven hundred and twenty
pounds of good Sound and every way well Conditioned Leafe Tobaccoe free
and Clear of all manner of trash whatsoever with Caske to Containe the Same
which to him he oweth and from his unjustly Deteyneth etc.

And Whereupon the Said William by Cleborn Lomax his Attorney Sayes
that whereas the Said Charles the 18th day of March in the year of our Lord
1691 [1692] att Charles Towne within the Jurisdiction of this Court by his
Certaine writeing Obligatory Acknowledged himself to owe and Stand Justly
Indebted unto the Said William of the Same place or to his heires Executors
Administrators or Assignes or Lawfull Attorney the full whole and Just Sume
of four thowsand Seaven hundred and twenty pounds of good Sound every way
well Conditioned leafe tobaccoe free and Clear of all manner of trash whatso-
ever with Caske to Containe the Same to be paid unto him the Said William
