because as well etc. and now here Att this day Came the Said parties by their
Attorneys aforesaid And the Juross thereon Impannelled being Called Likewise
Came (Viz:)

James Stoddard, foreman, John Chittam, John Pottinger, Archable Edmonson,

Morreen Devall, Joseph Harryson, John Sprigg, Charles Beall, John Davis,

John Dossett, Thomas Prather, Robert Biggs.

Who to Speake the truth Conserning the premises being Elected tryed and
Sworne doe Say upon their oaths that wee find for the plantiffs.

Therefore it is Considered by the Court here that his Said Majesty and
Abraham Feild [129] Recover against the Said John Gardiner the Sume of
three hundred and fifty pounds of tobaccoe the debt by Act of Assembly afore-
said by the Jurors aforesaid in forme aforesaid Assessed and their Damages by
occation of Deteyneing the Said debt to two thowsand one hundred Sixty six
pounds of tobaccoe to his Said Majesty and Abraham Field of their Assent by
the Court here Adjudged and the Said John Gardiner in mercy etc.

Richard Brockden plantiffe: William Powell Defendant.

Prince Georges County Ss: William Powell Late of Prince Georges County
planter was Atteched to Answer unto Richard Brockden of a plea of trespass
upon the Case etc.

And whereupon the Said Richard by Cleborn Lomax his Attorney Complaineth

that whereas the Said William Powell the 30th day of October in the
year of our Lord 1692 at Calvert County that is to Say at Charles Towne within
the Jurisdiction of this Court was Indebted unto the Said Richard in the Sume
of four hundred pounds of tobaccoe being Soe much tobaccoe that he the Said
William was Indebted to the Said Richard for four monts Servis of one Barbary
the wife of the Said Richard as by a pertickeler Account thereof hereunto An-
nexed Relation being thereunto had may more At Large Appeare and the Said
William to the Said Richard in manner aforesaid being Indebted Inconsidera-
tion thereof did Assume upon himselfe and to the Said Richard then and there
faithfully promise that he the Said William him the Said Richard the Said
Sume of four hundred lbs. of tobaccoe when he Should be thereunto Requested
would well and truly Content and pay Nevertheless the Said William his
promise and Assumption Soe as aforesaid made not at all Regarding but mind-
ing and Fraudulently Intending him the Said Richard the Said Sume of 400
pounds of tobaccoe Craftily and Subtilly to Deceive and defraud the Said Sume
of 400 lbs. of tobaccoe or any part thereof According to his promise and As-
sumption Soe as aforesaid made hath not paid Although the Said William to
doe the Same by the Said Richard Afterwards the day and place aforesaid was
often thereunto Requested but the Same to pay to the Said Richard hath hith-
erto denyed and Still doth denye to the damage of the Said Richard of 800 lbs.
of tobaccoe and thereof he bringeth his Suite etc.
