tobaccoe his debt for damages aforesaid as alsoe the Sume of two hundred and
twenty pounds of tobaccoe to the Said Henry Thompson for his Cost and Charges
in this behalfe laid out and Expended and by the Court here Adjudged etc. And
the Said Michaell Ashford in mercy etc.

Jonathan Willson plantiffe: Francis Collier Defendant.

Prince Georges County Ss. Francis Collier late of Prince Georges County
gentleman was Atteched to Answer unto Jonathan Willson of a plea of trespass
upon the Case.

And whereupon the Said Jonathan by William Bladen his Attorney Com-
playneth and Saith that the Said Francis the 20th day of September 1694 at
Benedict Leonard Towne that is to Say at Charles Towne within the Jurisdiction
of this Court being Indebted to the Said Jonathan in the Sume of Eight hundred
and ninty pounds of tobaccoe for Divers Licquors unto him the Said Francis and
by his order by the Said Jonathan delivered as by a pertickeler Account thereof
here brought in Court relation thereunto had may more at large Appeare and
the Said Francis being soe Indebted unto the Said Jonathan as aforesaid did then
and there Assume upon himselfe and to the Said Jonathan faithfully promise that
he the Said Francis the aforesaid Sume of 890 lbs. of tobaccoe unto the Said
Jonathan when he Should be thereunto Required would well and truly Content
and pay And the Said Jonathan in fact Saith that the Said Francis According to
his Assumption aforesaid 400 lbs. of tobaccoe part of the Said 890 lbs. of tobaccoe
unto the Said Jonathan did pay but as to 490 lbs. of tobaccoe Residue of the Said
890 lbs. of tobaccoe the Said Francis his promise and Assumption Soe as aforesaid
made not Regarding but Fraudulently Intending him the Said Jonathan in this
behalfe Craftily and Subtilly to deceive and Defraud the Said Sume of 490 lbs.
of tobaccoe Residue of the Said Sume of 890 lbs. of tobaccoe unto the Said
Jonathan hath not paid but the Same to pay doth Still denye and Refuse
Although often thereunto Demanded to witt the day and yeare aforesaid and at
divers other times and places to the Damage of the Said Jonathan 1000 lbs. of
tobaccoe Whereupon he brings this Suite.
