thereunto Requested would well and truly Content and pay Nevertheless the
Said Ninian his promise and Assumption Soe as aforesaid made Little Regarding
but minding and fraudulently Intending him the Said Hugh in this behalfe
Craftily and Subtilly to deceive and defraud the Said Sume of 800 lbs. of tobaccoe
or any part thereof According to his promise and Assumption aforesaid hath
not paid Although the Said Ninian to doe [118] the Same by the Said Hugh
Afterwards the day and place aforesaid was often thereunto Requested but the
Same to pay hath Denyed and Still doth denye to the damage of the Said Hugh
of 1500 lbs. of tobaccoe and thereupon he brings his Suite etc.

Calvert County Court Ss. November the 18th 1696 proved in open Court
by the oath of Mr. Hugh Ellis.

And the Said Ninian Beall by William Bladen his Attorney Cometh and de-
fendeth the force and Injury when etc. And prayeth Lycence thereof to Imparle
here untill next Court and it is granted unto him the Same day is given to the
plantiffe Lickewise.
At which Said next Court (to witt) the 26th day of January 1696 [1697] Came
here as well the Said Hugh Ellis as the Said Ninian Beall by theire Attorneys
aforesaid and the Said Hugh Ellis prayeth that the Said Ninian Beall to his
decleration aforesaid may Answer etc.
And the Said Ninian Beall by William Bladen his Attorney Cometh and de-
fendeth the force and Injury when etc. and Saith that he is not Informed by
the Said Ninian Beall his Clyant of any Answer for the Said Ninian Beall in
the plea aforesaid to be given and nothing more thereof Saith by which the
Said Hugh Ellis Remaineth against the Said Ninian Beall thereof undefended
etc.
Therefore it is Considered that the Said Hugh Ellis Recover against the Said
Ninian Beall as well the Sume of Eight hundred pounds of tobaccoe his damages
occationed by the premises aforesaid as alsoe the Sume of two hundred and
Eighteen pounds of tobaccoe to the Said Hugh Ellis at his Request for his Costs
and Charges in this behalfe Sustained and by the Court here Adjudged etc. and
the Said Ninian Beall in mercy etc.
This Following Action was transmitted out of the Records of Calvert County
upon the devision of the Countys.
Samuell Scott plantiffe Ninian Beall Defendant.
Calvert County. Ss. Ninian Beall Late of Calvert County gentlemen, was
Atteched to Answer unto Samuell Scott of a plea of trespass upon the Case etc.
And whereupon the Said Samuell Scot by Samuell Watkins his Attorney Com-
plaineth that whereas the Said Ninian Beall the 20th day of November Annoque
Domini 1695 At Calvert Towne within the Jurisdiction of this Court Stood
Justly Indebted unto the Said Samuell Scott in the Sume of Seaven hundred and
Seaventy pounds of tobaccoe he the Said Ninian Beall did the day yeare and
place aforesaid deliver unto the Said Samuell Scott one noate or order with the
proper hand and name of the Said Ninian Beall Subscribed and to one Mr.
William Parker directed for payment thereof and the Said Ninian Beall After-
wards to witt the day yeare and place aforesaid inconsideration of the premises
