Said Charles Tracey Remaineth against the Said John Clackson thereof unde-
fended etc. Therefore it is Considered that the Said Charles Tracey Recover
against the Said John Clackson as well his dammages occationed by the premises
aforesaid to three hundred pounds of tobaccoe as alsoe the Sume of two hundred
Seaventy five pounds of tobaccoe to the Said Charles Tracey of his Assent for his
Cost and Charges in this behalfe Sustained etc. by the Court here Adjudged etc.
And the Said John Clackson in mercy etc.
Daniell Buckmaster plantiffe: Richard Moore Defendant.
Prince Georges County Ss. Richard Moore late of Prince Georges County
planter was atteched to Answer unto Daniell Buckmaster of a plea of trespass
upon the Case etc.
And whereupon the Said Daniell by William Stone his Attorney Complayneth
that whereas the Said Richard the 20th day of November in the year of our Lord
1696 at Charles Towne within the Jurisdiction of this Court was Indebted unto
the Said Daniell in the Sume of Eight hundred lbs. of tobaccoe as by pertickeler
Account thereof here Ready in Court to be produced more at Large may Appeare
and the Said Richard In consideration thereof did Assume upon himselfe and to
the Said Daniell then and there faithfully promise that he the Said Richard the
Said Sume of 800 lbs. of tobaccoe to the Said Daniell when he Should be there-
unto Requested would well and truly Content and pay Nevertheless the Said
Richard his promise and Assumption aforesaid not at all Regarding but minding
and fraudulently intending him the Said Daniell in this behalfe Craftily and
Subtilly to deceive and defraud the Said Sume of 800 lbs. of tobaccoe to the Said
Daniell hath not paid Although the Said Richard to doe the Same by the Said
Daniell Afterwards the day and place aforesaid was often thereunto Requested but
hath hitherto Refused and Still doth Refuse to the Dammage of the Said Daniell
of 1600 lbs. of tobacco and thereof he bringeth his Suite etc.

The plantiffe by his Attorney aforesaid Sues the defendant in a plea of trespass
upon the Case etc. And the Sheriff maketh Returne of the writt here that the Said
Defendant is not to be found in his balywick and alsoe the Said plantiffe have
Caused a Coppy of the Decleration to be left at the house w[h]ere the defendant
Last Lived in this County And alsoe on part of the Said plantiffe it is testified
here in Court that the Said Defendant hath Elloined himselfe out of the Juris-
diction of this Court.
Whereupon the Said Daniell Buckmaster by his Attorney aforesaid prayeth
that he may have an Attechment against the goods Chatties and Creditts of the
Said Richard Moore as well for the Said Sume of Eight hundred pounds of
tobaccoe the Debt for Damages aforesaid as alsoe the Sume of four hundred forty
and five pounds of tobaccoe to the Said Daniell Buckmaster at his Request for his
Costs and Charges in this behalfe Laid out and Expended etc. And by the Court
here it is granted unto him etc.
