two hundred thirty four pounds of tobaccoe to the Said Edward and Dudley
Carleton for their Costs and Charges in this behalfe Sustained And by the Court
here Adjudged etc. And the Said George Young in mercy etc.

Prince Georges County Ss. William Westry Late of Prince Georges County
Cooper was Atteched to Answer unto Charles Tracy of a plea of trespass upon
the Case etc.

And whereupon the Said Charles by Joshua Cecell his Attorney Complaineth
that whereas the Said William at Divers dayes and times between the 23d day
of December and the 14th day of January in the yeare of our Lord 1695 [1696]
Att Charles Towne within the Jurisdiction of this Court was Indebted unto the
Said Charles in the Sume of Six hundred fifty five pounds of tobaccoe being for
Severall Licquors dyetts Lodgins ordinary Expences by the Said Charles Sold and
delivered him the Said William as by a pertickeler Account thereof here in Court
produced relation being thereunto had may more at Large Appeare and the
Said William to the Said Charles in manner aforesaid being Indebted In con-
sideration thereof did Assume upon himselfe and to the Said Charles the Said
14th day of January att Charles Towne aforesaid faithfully promise that he the
Said William him the Said Charles the Said Sume of 655 lbs. of tobaccoe when
he the Said William by the Said Charles Should be Afterwards thereunto Re-
quested [94] would well and truly Content and pay Nevertheless the Said
William his promise and Assumption Soe as aforesaid made not at all Regarding
but minding and Fraudulently Intending him the Said Charles in this behalfe
Craftily and Subtilly to Deceive and defraud the Said Sume of 655 lbs. of
tobaccoe or any part thereof to the Said Charles hath not paid Although the
Said William to doe the Same by the Said Charles Afterwards the 15 day of
January in the year of our Lord 1695 [1696] at Charles Towne aforesaid was
often thereunto Requested but the Same to pay to the Said Charles the Said
William hath hitherto Refused and Still doth Refuse to the Damage of the Said
Charles of 1000 lbs. of tobaccoe and thereof he bringeth his Suite etc.
