NOVEMBER, 1696 COURT 101

one pound and Eight Shillings Sterling the Said Matthew did Assume upon
himselfe and to the Said George promised that he the Said Matthew when there-
unto Required the Said one Scale Protractor Compass Chaine and deviders
would well and truly unto the Said George or order deliver againe and the Said
George in fact Saith that trusting to the faithfull promis and Assumption of of
him the Said Matthew So as aforesaid made did Lend unto him the Said
Matthew the Said Scale Protractor Compass Chaine and deviders Yet the Said
Matthew his promise and Assumption Soe as aforesaid made Little Regarding
but deviseing and fraudulently Intending him the Said George of the Said Scale
Protractor Compass Chaine and deviders Craftily and Subtilly to deceive and
defraud hath not delivered Although he hath been often thereunto required but
the Same to doe hath denyed and Still doth denye to the damage of the plantiffe
of £2 10s OOd Sterling and thereupon he brings his Suite.

Pledges to procecute John Doe, Richard Roe. John Meriton for the
plantiffe.

And the Said Matthew Mockeboy by Steven Blanshford his Attorney Cometh
and defendeth the force and Injury when etc. and prayeth Lycence thereof to
Imparle here untill next Court and it is granted unto him the Same day is
given to the Said George Burges etc.

Att which Said next Court (to witt) the 24th day of November Annoque
Domini 1696: Came here as well the Said George Burges as the Said Matthew
Mockeboy by their Attorneys aforesaid And the Said George Burgis prayeth that
the Said Matthew Mockeboy to his Decleration aforesaid May Answer etc.

And now here at this day Came the Said Matthew Mockeboy by his Said
Attorney and defendeth the aforesaid Force and Injury when etc. And the Said
Attorney Saith that the Said Matthew Mockeboy did not Assume in manner
and forme as the plantiffe in his decleration aforesaid Complaineth and of this
he putts himselfe upon the Country. Steven Blanshford.
And the plantiffe Alsoe. John Meriton.

Therefore it is Commanded the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because
as well etc. and now here at this day here Came as well the Said George Burges
as the Said Matthew Mockeboy by their Attorneys aforesaid and the Jurors
thereon Impanelled being Called Likewise Came (to witt)
James Stoddart, foreman, John Chittam, Archable Edmonson, Samuell
Magruder, William Powell, Joshua Hall, John Demall, John Browne, Car-
penter, John Browne, Jr., Hugh Reyley, Charles Hay, Thomas Plumer. Sum-
moned per Thomas Greenfeild, Sheriffe.

Who to Speake the truth Conserning the premises being Elected tryed and
Sworne upon their oaths doe Say (wee find for the plantiffe: Upon which the
Said plantiffe prayeth his Judgment to him by the Court here on the verdict
aforesaid to be Rendered etc. And the Said Defendant Saith that the Court
here ought not to proceed to render their Judgment upon the verdict aforesaid
because he Saith he has good Cause in Arrest of Judgment and prayeth time to
file his Reasons in the Same Whereupon the Court Allowed the Said Defendant
twenty Dayes to file the Same.

Prince Georges County Ss: George Young Late of Prince Georges County
planter was Atteched to Answer unto Edward and Dudley Carleton of a plea of
trespass upon the Case etc.
