directors shall have and are hereby given all the
powers for the keeping of said road in repair, that
were vested in them for the purposes of construction
by the acts to which this act is a supplement.

Cannot agree.

SEC. 2. And be it enacted, That if the said president
and directors can not agree with any of the proprietors,
owner or owners of any land, that may be selected
and required by them in constructing the said road,
authorized by said original act, or in extending the
same as authorized by this act, or fur any material,
such as stone, gravel, timber, &c., required for the
purpose of constructing or repairing said road as
authorized by said original act, or in extending the
same as authorized by this act, or in case the owner
or owners thereof are minors, feme covert or non compos
mentis, or not resident of the County of Frederick, it
shall and may be lawful on application of said presi-
dent and directors, for any justice of the peace in
and for Frederick county to issue his warrant to the

mon twenty persons qualified to act as jurors, not
interested in the property to be valued, to meet at
or near the property to be valued, on a day named
in said warrant, not less than ten nor in ore than twenty
days after the issuing of the same, and if at the time
named in said warrant any of the said jurors sum-

moned do not attend, the sheriff shall immediately
summon as many more, qualified to act as jurors as
may be necessary, with the jurors in attendance, to
form a panel of twenty jurors, and from them each
party or his agent, or if either party be not present in
person or by agent, the sheriff, for such party, shall
strike off four jurors, and the remaining persons shall
act as the jury for the inquest of damages; that before
the said jury shall proceed to act, the sheriff shall
administer to each of them an oath that he will justly
and impartially value the damages which the owner
shall sustain by the condemnation of said property
required by the said president and directors for the
purposes aforesaid.
