chartered privileges of said railroad company on such terms and after such notice as were in such decree prescribed; and

WHEREAS, afterwards the said trustees did sell at public sale all the said estate, property, franchises, rights and chartered privileges to Charles H. Hutch-inson, W. D. Winsor. Charles E. Hopkins, John Kearney, Charles Hart, John Welsh, Edward Ingersol, John T. Montgomery, Jacob Tome, Seth Caldwell, Jr., George W. Russell, Joseph Bringhurst, D. N. Staunton, Robert Young, George B. Newton, Richard Sharp, F. Weiss, T. Morris, Perot, C. S. Rutter, Jr., M. B. Mahouey, Gustav A. Schleus, Alexander Maxwell, Francis H. Greenwood, Joshua Kelly, Jen-nings Hood, J. M. Tharp, Benjamin T. Biggs, John Wilkinson, Cordyu Wreick, Philip Quigley, Patrick H. Irvin, William Whitelock, Samuel S. Woolston, Charles W. Leavitt, John B. Boyle, William F. Frick and Joshua C. Jenkins, the same being the holders of all the bonds of said railroad company to secure which the said mortgage had been given; and

Preamble.

WHEREAS, the said sale was duly reported by said trustees and finally ratified by the said court, and the said purchasers above named, fully complied with the terms of sale and surrendered to said trustees all the said bonds, and the said trustees by their deed of twenty-first of April eighteen hundred and seventy-five, recorded among the land records of said Queen Anne's county in Liber J. W. number five, folio twenty-four et seq. did convey to the said above named purchasers, their heirs, successors and assigns, the said Queen Anne's and Kent Railroad, and all the estate, property, franchises, rights and chartered privileges thereof; and

WHEREAS, as the said purchasers have been advised that they can with greater safety and advantage hold and exercise the rights and franchises by said sale and deed vested in them, by being incorporated by act of the Legislature; and

WHEREAS, no general law exists in this State providing for the creation of corporations for the purpose of holding and operating railroads already
