space of six months, and twelve months in the State, next preceding the election, shall on the first Monday in May annually, at such place as shall be designated by the president and commissioners by a notice to be put up in at least five of the most public places in said town at least one week before the day of election, elect by ballot five judicious and discreet persons, citizens of the United States, who shall have resided within the limits of said town for at least twelve months next preceding the election, as com-missioners of said town; the persons thus elected as commissioners shall within one month after their	Elect by ballot.
election, qualify by taking the oath prescribed by the sixth section of the first article of the Constitution of Maryland, before a justice of the peace in and for Cecil county, and at their first meeting, which shall be within one month after the election, they shall choose from their own body a president, who shall preside at all meetings of the commissioners, and vote on all questions before them. 88. If any of said commissioners, after they are elected shall refuse to qualify or shall after they have qualified die, resign, remove from said town, or be otherwise disqualified, an election to fill said vacancy shall be held after two weeks previous public notice, to be put up as aforesaid by said president and commissioners, by hand-bills and posted at the	Fill vacancies
Post Office, and at three other public places in said town; provided, that no election to fill vacancies shall be held so long as three of the commissioners shall remain who have been duly elected and qualified, and the said remaining commissioners, not less than three, shall have all the powers conferred upon said president and commissioners as fully, to all intents and purposes, as if the whole five 'were in office, duly qualified. 39. All such elections shall be held and conducted as shall from time to time be directed by the by-laws of the corporation not inconsistent with the provisions of this article. If the inhabitants of said town shall at any time neglect to make an election at the time herein mentioned, the power of electing commissioners shall not cease, but the right and power	Held and conducted.
