JOHN LEE CARROLL, ESQUIRE, GOVERNOR. 205 CHAPTER 132.

AN ACT of the General Assembly of Maryland to make valid the acts of the commissioners appointed by the act of the General Assembly of Maryland, passed at December session eighteen hundred and forty, chapter two hundred and nineteen, and to confirm the proceedings of said commissioners.

WHEREAS, by act of the General Assembly of Maryland, passed December session eighteen hundred and forty, chapter two hundred and nineteen, approved March ninth, " eighteen hundred and forty-one, entitled " an act for the opening of a new alley and for the sale of part of Cherry alley, in the town of Cumberland, " Bene S. Pigman, George Shuck, and George W. Devecmon were appointed commissioners with power and authority to open said alley, and also to sell and convey that part of Cherry alley lying between Washington street and Green street,

AND WHEREAS, the Mayor and Councilmen of the town of Cumberland accented said act of Assembly, by resolution passed April twenty-sixth, eighteen hundred and forty-one, and due notice thereof was given, as required by said law,

AND WHEREAS, two of said commissioners, viz: Bene S. Pigman, and George W. Devecmon, proceeded under said act of Assembly to lay out said new alley and did lay out same, and also did advertise and sell said part of Cherry alley lying between Washington and Green streets to one John Hoye, who fully paid the purchase money therefor, and received a deed therefor, dated on sixth day of August, eighteen hundred and forty-one, and at once took possession of said part of Cherry alley, and has remained in the possession thereof ever since, and those claiming under said John Hoye,

AND WHEREAS, as but two of said commissioners named in said act of Assembly, discharged the trust reposed in them, there is now some doubt whether the act of said commissioners was altogether legal,
