Repealed.

sive, of the Public Local Laws of Baltimore county,
entitled " Collector, " and sections seventy-eight to
ninety inclusive, entitled "Treasurer, " be and the
same are hereby repealed and the following sections,
entitled " Treasurer and Collector, " enacted in lieu
thereof:

SEC. 2. Be it enacted. That at each general election
held in Baltimore county, the legal voters thereof
shall elect by ballot a treasurer whose duty it shall
be to receive all monies which may be due the said
county and pay all claims against the same.

Take oath.

SEC. 3. The person so elected, before he enters
upon his office, shall take an oath in due form of
law, to be administered by either of the Judges of
the Circuit Court, faithfully to perform the duties of
the same, and shall receive compensation for his
services at the rate of twenty-five hundred dollars
per annum.

Give bond.

SEC. 4. He shall also execute to the State of Mary-
land a good and sufficient bond, to be approved by
the county commissioners, with not less than two
securities in the penal sum of forty thousand dol-
lars, for the faithful performance of his duties, and
the securities, so required, snail make oath in due
form of law that they are possessed in their own
right of unencumbered real estate, situated in Balti-
more city or county, equal in value to the amount of
their bond; it shall be the duty of the county com-
missioners thereupon to cause the records to be
searched by a competent person for the purpose of
ascertaining the truth of such oath, and the person
making the search shall, under oath, report to the
commissioners the result of such examination.

SEC. 5. In default of the person so elected to ex-
ecute the bond hereinbefore required, or in the event
of the treasurers removal, death or resignation, the
county commissioners shall declare the said office
vacant and shall at once proceed to fill the same by
the appointment of a suitable person for the re-
mainder of the term, who before he enters on its
duties shall qualify and bond as hereinbefore directed.
