LAWS OF MARYLAND.

Annual levy.

shall annually levy upon the assessable property of
said county a tax sufficient to pay the interest there-
on and the principal of such portion as may mature
in each and every year after the date of their issue,
and said levy shall be designated as "School fund. "

Be paid over.

SEC. 4. And be it enacted, That the proceeds arising
from the sale of the afore mentioned bonds shall be
paid over by the county commissioners to the trea-
surer of the school commissioners of said county,
who shall immediately apply said proceeds to the
payment of the aforesaid indebtedness. now due by
said school commissioners, and to no other purpose.

pend.

SEC. 5. And be it enacted. That hereafter the school
commissioners of said county shall not expend for
school purposes or for any other purpose a greater
sum of money in any one year than shall be annu-
ally levied for school purposes by the county com-
missioners of said county in addition to the amount
annually received by said school commissioners from
the treasurer of the State, and they shall not borrow
any sum or sums of money in any one year which,
added to the actual receipts for such year, would ex-
ceed their yearly income as provided for by law,
and it shall be lawful for the holders of any indebt-
edness or any evidence of indebtedness contracted in
violation of this section to sue upon or enforce the
same in any court of law or equity in this State,
against said school commissioners either individu-
ally or collectively.

SEC. 6. And be it enacted, That in case of the de-
struction of any school house by fire or otherwise,
the board of school commissioners may with the
concurrence of the board of county commissioners
borrow so much and no more money as may replace
such school house, and such money shall be applied
to the rebuilding of such house and to no other pur-
pose whatever, and the county commissioners shall
provide for such indebtedness by an additional levy
in the following year.

Repealed.

SEC. 7. And be it enacted, That all laws inconsistent
with the provisions of this act be and the same are
hereby repealed.
