SEC. 10. And be it enacted, That if the capital stock
of said company shall be deemed insufficient for the
purpose of this act, then and in that case it shall and

directors shall have power to lay off and construct
a railroad not exceeding one hundred feet in width,
with one or more sets of tracks, from such point
upon the Philadelphia, Wilmington and Baltimore
Railroad, at or not more than three-fourths of a mile
from the town of Elkton, as they shall determine, to
the boundary line between the States of Delaware
and Maryland, so as to connect with a railroad to be
built from the Delaware Railroad to said State
boundary line, and also to locate and construct an
extension and lateral branches of the said railroad
to any point or points in Cecil county in this State,
which may be deemed needful or eligible, and for
the purpose aforesaid to enter upon any land neces-
sary for locating, laying out, surveying or making
the same or any part thereof, or to procure land,
gravel, earth, wood or timber, said timber not to be
condemned if off the line of said railroad for such
use, and to obtain the right and title to the same as
hereinafter provided, and for the purpose of laying
off and constructing the said railroad, they shall
