ESCAPES.—Where the escape is effected by the party himself, although the offence may have been originally bailable, he will have forfeited his right to bail for having committed the additional transgression, which will create a presumption of his guilt. Where it is effected by a third party it amounts to the same species of crime as that for which the principal was confined, and the question whether the party aiding the escape is entitled or not to be bailed will of course depend on the crime with which that principal is charged; see Stat. 1 E. 2, St. 2; 2 Inst. 188; 1 Hale P. C. 102; 2 Hale P.
