•CONFESSION OF CRIME.—All those who in their examination own themselves
guilty of a felony alleged against them, and are charged in the mit-
timus with the felony so confessed, seem to be excluded from bail, for
bail is only proper when it stands indifferent whether the party be
guilty or innocent. The Statute expressly mentions manifest of-
fences, 2 Inst. 189.

ESCAPES.—Where the escape is effected by the party himself, although the
offence may have been originally bailable, he will have forfeited his
right to bail for having committed the additional transgression, which
will create a presumption of his guilt. Where it is effected by a
third party it amounts to the same species of crime as that for which
the principal was confined, and the question whether the party aiding
the escape is entitled or not to be bailed will of course depend on the
crime with which that principal is charged; see Stat. 1 E. 2, St. 2;
2 Inst. 188; 1 Hale P. C. 102; 2 Hale P. C. 133; Code, Art. 30, sec.
51.12
FORGERY.—At common law forgery was a misdemeanor and therefore bail-
able, but the greater number of forgeries are now felonies, Code, Art.
30, secs. 24, 25, 29-37."
*FUGITIVE CONVICTS.—Any fugitive convict escaping to this State shall 60
be deemed a fugitive felon, and being convicted by a duly authenti-
cated record of the Court of the State, in which his conviction took
place, shall be sentenced to the penitentiary for the residue of the
term for which he was convicted, but is to be delivered up on de-
mand, Code, Art. 30, sec. 55.1*
