546 14 ELIZ. CAP. 9, TALESMEN. as the Plaintiff or Demandant in any Suit or Action, may have the same, by any Statute or Ordinance heretofore made or set forth; (3) and the rather for the speedy Trial of the Issue and. Issues joined, or hereafter to be joined in any Plea, Suit or Action; any Lav, Custom or Usage heretofore used to the contrary thereof in any wise notwithstanding. 406* II. Provided also, and be it further enacted by the Authority aforesaid, That in all popular Actions, Informations, Hills or Suits commenced or had, or hereafter to be commenced or had in any the Queen's Majesty's Court of Record, upon any Penal Laws or Statutes, wherein any Person doth or shall sue or prosecute, or inform, as well for the Queen's Majesty, her Heirs and Successors, as for himself, whereupon Issue is or shall be joined to be tried by the Country, That therein the Party De- fendant or Defendants shall be admitted to pray, and have a Teles de Circumstantibus, as in other Cases aforesaid.
