such Sheriff, or other Minister or Ministers, shall be added to
the former Panel, and their Names annexed to the same; as
by the said Act more at large appeareth: (3) which Statute
was made to endure till the end of the next Parliament, and
after was, and is from Time to Time continued, and doth now
remain, stand, and be in Effect; (4) which Act doth not extend
to any Jury impanelled to try an Issue joined between the King
and the Party, or between such as pursue any Matter for the
King and themselves:
377* U- Be it therefore enacted, ordained and established by
the King and Queen's Majesties, the Lords Spiritual and Tem-
poral, and the Commons in this present Parliament assembled,
and by the Authority of the same, That from and after the first
Day of June next coming the Justices of Assise and Nisi Prius
before whom any Trial shall be made, by Virtue of any Writ
of Habeas Corpora, or Distringas, with a Nisi Prius, where
a full Jury shall not appear, or after Appearance of a full Jury
by Challenge, the Jury is like to remain untaken for Default
of Jurors, shall have Authority by Virtue of this Act, upon
Request made for the King and Queen, her Heirs or Successors,
by any authorised thereunto, or assigned by the Justices of the
Court, before whom the said Inquest shall be taken, or upon
Request to be made by the Party that followeth as well for the
King and Queen, her Heirs and Successors, as for himself,
upon any Penal Statute, or his or their Attorney, to command
the Sheriff, or other Minister or Ministers to whom the Making
of the said Return shall appertain, to name and appoint, as
often as need shall require, so many of such other able Persons
of the said County, then present at the said Assizes, or Nisi
Prius, and to add and annex the Names to the former Pannel,
as shall make up a full Jury of twelve Men, for the Trial of
every such Issue:
III. And that all and every Clause, Sentence, Article and
Proviso, comprised in the said former Act, shall be taken, inter-
preted and expounded, to give the like and the same Advan-
tage and Commodity to the King and Queen's Majesties, her
Heirs and Successors, and all such Person and Persons as shall
pursue any Action, Bill, Plaint or Information for the King
and Queen's Majesties, her Heirs and Successors only, or for
them and the Party, as the Party Plaintiff in any other Action
should or might have, by Virtue of the said Act, in such Form
