appeal entered therefrom, bond filed, and record transmitted to the Court
of Appeals, the trial court has no jurisdiction to entertain a motion to strike
out the judgment on the ground of fraud, surprise and the like. An affirm-
ance of a judgment by the Court of Appeals precludes the lower court from
vacating it unless the cause is remanded for further proceedings. United
Rys. Co. v. Corbin, 109 Md. 52. Cf. Md. Steel Co. v. Marney, 91 Md. 360;
Avirett v. State, 76 Md. 510.
Practice Act of Baltimore City.—The same principles which control the
court in the matter of striking out judgments in ordinary cases apply
to judgments obtained under secs. 312 et seq. of the Balto. City Code.
Girard Ins. Co. v. Bankard, 107 Md. 538; Boggs v. Mining Co., 105 Md.
371; Mueller v. Michaels, 101 Md. 191; Laubheimer v. Johnson, 98 Md.
685; Glenn v. Allison, 58 Md. 527; King v. Hicks, 32 Md. 460.

CAP. VII.
The Justices of Peace and the Sheriffs shall arrest those which com-
mit any Riot &c., inquire of them, and record their Offences,
Item, it is ordained, and es-
tablished, That if any Riot,
Assembly, or Rout of People
against the Law. be made in
Parties of the Realm, that the
Justices of Peace, three, or
two of them at the least, and
the Sheriff or Under-Sheriff
of the County where such
Riot, Assembly, or Rout shall
be made hereafter, shall come
with the Power of the County
(if need be) to arrest them,
and shall arrest them; (2)
and the same Justices and
Sheriff, or Under-Sheriff, shall
