( 47 ) ffebruary 12th. 1690/1 Margerett & Annellope Reed plts C Scieri facias being mad known and retournd pr Sheriffe.the Ellis appring agt in Court, but shewing no cause why Execution should not issue agt him for John Ellis Senr & Elizabeth his wife dfts 2000lb. of tobacco as also 25 dayes worke due to Wm.Morris as appears pr Ordr. of Court 12 th. day of June 1689. with charges This Court Orders Execution for the same Margaret & Annellope Reed plts. Scieri facias being made known and returnd in Court. but no Cause agt. shown by the Defendts ---Court Orders Execution agt defts Wm: Coulborne Currier & Eliz his wife defts for 800lb.tobacco to be pd to ye plts. as pr Ordr. past 12th. day of June 1689. and Charges . - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Henry: Sadbury. Plt. Somerset County Ssc. Thomas Clifton of this County Cordweiner was agt. attached to answer unto Henry Sadbury in a plea of debt . - - - - - - - Thomas: Clifton. Deft And whereupon the plt by Edward Jones his Attorney saith that the said - - - - - - - - - - Thomas upon the 21th. day of Aprill and in the year of our Lord.1682 then Then became indebted unto the plt in the quantity of eight pair of good well made shoos, as doth appear by A Certain writing under the hand and seal of the defendt and here in Court produced but the deft litle regarding his promise and assumption, but fraudulently intending the plt to deceive in the quantity of eight pair of shoose / although often thereunto required hath hitherto neglected to pay and still doth neglect to pay, whereupon the plt saith he is damnified and hath losse to the value of 12 pair of the like shoos. and hereupon brings his suit. pr Quer. Edward Jones . C Then was this following Bill produced and read in Court. This Bill bindeth me Thomas: Clifton of the Counrty of Somerset Cordweiner to pay or Cause to be paid unto Henry: Sadbury of the County of Accamack in the quantity of eight pair of good well made shoos that is to say two pair of mens french falls for to be delivered by whitsuntide next ensueing the date hereof, and one pair of mens falls to be delivered by the last of August and three pair of womans falls and one pair of mens falls to be delivered by the 25 of December next ensueing to the true prformance here of I bind me my Heirs, Execcutors Admrs or Assigns as witness my hand and seal this 21. of April:1682.
