( 45 ) Mr. Francis Jenckins Plt.} Somerset County Ss. Walter Lane was attached to Answer unto agt. ffrancis Jenckins Gentm Admr of all and singular the goods chattels Walter. Lane Defendt. and Credits of Samuel: Cooper deceased, of a plea of trespass upon - - - - - - - - - - - - - the Case And whereupon the said ffrancis by Peter Dent his Attorney Complaineth that whereas the sd Walter the 23d. day of August in the year of our Lord 1685 at Pocomoke within the Jurisdiction of this Court was indebted to the said Samuel in his lifetime in the sum of eight hundred ninety two pounds of tobacco as by a perticuler account thereof here in Court to be produced may appear, and the sd Walter to the said Samuel in manner aforesd being indebted, did assume upon him self and to the sd Samuel faithfully promise yt he the said Walter the sd sum of 892: Pounds of tobacco to the sd Samuel would well and truly content and pay nevertheless the sd Walter his promise and assumption aforesd not regarding, but minding and fraudulently intend ing him the said Samuel in this behalf to deceive and defraud the said Sum of 892 Pounds of tobacco to the said Samuel in his lifetime nor to the said ffrancis Admr as aforesd hath not paid, but hatehitherto refused and doth Still refuse to the damage of the said ffrancis of 1600 Pounds of tobacco and thereof he brings this Suit &c. ---- * * * * * * Dent. pledge &c. Therefore the Court grants Order July 12. to 5 potles of flip - - - - 130 agt the deft for the Sum of 892lb. of tob according 20 1. potle of flip - - - - - 30 to declaration. Augt. 18 1 quart of flip - - - - - 15 21. 1 gallo. of flip - - - - - 60 23 3. quarts of flip - - - - 45 to George Seawards note. 185 to your Brothers accot. ---- 34 168lb.of tob pd yu by Coll Stevens 168 to my selfe ag R:Blades in mr Sandrs - -100 Sum 892lb. tobo mr ffrancis Jenckins Admr of Saml Cooper decd - - - - - - - - - - - - - - - - - - - - - - The abovesd mr ffrancis Jenckins, being upon Second tryall agt the sd Walter Lane as Execcutor to Josias: Seaward late of this County deceased, but for some reasons given by sd Lanes Attorney J. S. to the Court the tryall was suspended. the sd Jenkins requested of the Court then, whether the abovesd Lane were Execcutor to the sd decd Seaward or no, whose judgmt. was that Lane was Execcutor Tho: Dixon. here maketh Oath that he hath tended as an Evidence in a matter of Controversie depending betwixt Owen Guider plt and Patrick Reed deft. on part of the plt. twenty dayes.
