xber 10th. 1690 ( 20 ) Thomas: Morris Plt. Sangster p plt agt Dent p deft Attorneys. Joyns Issue and referrs the Wm: Innis. Deft. C whole matter to the Court. Somerset County, Ssc. William: Innis of this County Constable was Sommoned to answer unto Thomas Morris of the same County in a plea of Trespass of the Case. - - - - - - - - - - - - - - - - And whereupon the plt by James. Sangster his Attorney Comes and sayes that the deft upon the 11th day of Septembr 1688. did require and comand Thomas: Pindry of Boquetenorton to presse a horse in Order to carry & transport Henry Bowman out of this County into Sussex County in the Province of Pennsilvania according to which Ordr the said Pindry did presse the plts horse and him the said Bowman did transport, and by excessive riding and ill usuage hath so abused the plts horse that he is made uncapable of any manner of Service, though the plt hath used all his Care and endeavour to help and cure the sd horse. To the plts great losse & damage, not only in the want of the horses service, but charges also in endeavouring a Cure which could not be performed to the value Two thousand pounds of tobacco and thereupon brings this suite. These are in the name of the Right Honourable the Lord Proprietor to will & require you Thomas Pindry, and by these presents I do constitute and impower you the said Pindry in my stead to presse any horse you can meet with bridle and Sadle, for the transporting of Henry Bowman into Sussex County. And for your so doing this shall be your warrant given under my hand this 11th. day of September. 1688. William: Innis. To the worshipfull Court of Somerset County, your Petioner humbly sheweth, that whereas his horse being prest by Order of the Constable for the sea board side, your Petioner did in November Court make his address to your worps with his complaint of his great damage he hath sustained by the ill usuage of his horse. your Petioner having shown his horse to mr James: Round and mr Hopkins while he was in that Condition C which is not well yett, some of your worps then thought that no legall way for me to petion to yr worps for satisfaction from the public for privat wrong done me. I have now sued the Constable, hope yr worps will be pleased, to take it into your Consideration, that as it was refused by your worps, to allow me damage then, that now I may not Suffer, for want of Satisfaction for the abuse done to my horse, and selfe in the great want I have of him and cannot make that use I might if he had not been so disabled, if authority will not allow it because the prisoner was carryed out of the Province, I affirme that it must be a privat injury done to him who appeals to your worps for Justice which I doubt not, and your petioner as bound shall pray &c. Thomas: Morris The Court having Considered the abovesd proceedings, do find it no cause of action I John: Barron do swear that I have tended on the action of Thomas:Morris plt and Wm:Innis deft 16:dayes.
