Selby defendant. I the said Peter Lowder to the best of my knowledge Sometime in June last did at my house hear Richard. Holland say that the last time he had the Assignment which he had of Daniel: Selby for a Servant boy was in his Coat pockett, and that he never see it Since, or know nothing of it as witness my hand Memorandum that this day being the 8th. day of Augo 1691 Peter: Lowder. Came personally before me the above mentioned Deponent Peter. Lowder, and made Oath upon the holy Evangelist to the truth of all above written. wittness my hand. Saml. Hopkins. - - - - - - - - - - - - - - - - - - - - - - The Deposition of John: Tarr. Aged thirty five years or more. This Deponent Saith that the last Autum or fall of the leaf, there happening Some Controversie between Thomas Oxford & Stephen Page about misusuage of Swine belonging to the said Oxford. I the Deponent & the sd Oxford had leave granted by the sd Page to view the said Pages ffence, the which we did doe, and we found it Sundry places defective and very insuffitient, by discovering wide holes therein in divers pannels of the sd ffence, where swine might without difficulty pass and repass through holes in the said ffence, One hole as to the Deponents understanding at least 18: Inches wide, and we the said viewers, did take notice that there was no Corne at all in the said Pages Corne field nor Scarce any Stalks of Corne, where it was said great damages was done, to the sd Oxfords Swine by Pages people, and this Deponent further saith, that the sd Page did acknowledge yt hunting or Souling of One hogg that moring, before viewing of the sd fence, and the sd Oxford desireing A reason of the said Page, why he sould the sd hogg, but Page answered because you askes me three shillings a bushel for Corne. this the Deponent Saith and further saith not, to the truth whereof he hath hereunto Sett his hand. John: JT. Tarr. his marke Memorand~ that this day being the 10th. day of Augo. 1691. Came John: Tarr the sd Deponent, and made Oath before me upon the holy Evangelist to the truth of all above written. wittness my hand Saml. Hopkins The Courts adjourned till ye Second tuesday in September 1691. for want of Commissioners mr Round departing the Court. |
