June. 12th. 1691 ( 126 ) Capt. Wm: Coulbourne, Plt. Somerset County Ss. James: Barry of this County Tanner was attached Contra. to answer unto Capt. Wm: Coulborne. Extr.and Admr of all & singular James: Barrey. Deft. the goods and chattels of Coll.Wm:Coulborne, late of this County deceased - - - - - - - - - - in a plea of debt. &c. And whereupon the plt by James: Sangster his Attorney Comes and Sayes that the deft is become & Stands indebted unto the plt in the full and just Sum of four hundred and fourteen pounds of good & Sound Mertable tobacco in Caske payable Convenient in the abovesd County, according to Act of Assembly at or upon the tenth day of October next and imediate after the date of a Certain Spetialty under the hand and Seal of the Said deft bearing date the 26th: day of Sept. 1688. as doth and may more fully appear by the sd Spetialty, which is here in Court produced, wherein the sd deft. did bind himself his Heirs, Extrs and Admrs to pay or cause to be paid the said Sum of 414lb of tobacco to the sd Coll. Wm: Coulborne, his Heirs, Extrs. Admrs or Assigns,but the sd deft ~ litle regarding the foresd Spetialty, but fraudulently and Craftily intending to deceive the plt of the same hath hitherto delayed and denyed payment though often thereunto required, whereby the plt sayes he is damnified & hath losse to the value of Eight hundred twenty and eight pounds of like tobacco in Caske and hereupon brings this Suite James: Sangster pr Quer. pled prsois. Jno: Doe Rich: Roe This Bill bindeth me James Berry of Somerset County in the Province of Maryland Tanner my Heirs Execcutors and Admrs. to pay or cause to be paid unto Coll. Wm: Coulborne of the aforesd County Gent his Heirs Execcutors , Extors Admrs or Assigns the full and just Sum the full and just Sum of four hundred and and fourteen pounds of good Sound Merchantable tobacco in Caske Convenient according to Act of Assembly in the aforesd County at or upon the 10th. day of October next ensueing the date hereof, as wittness my hand and Seal this 26th. day of September. 1688: James: Barry. ? Sworn before me James: Round. in Court. Bryan: Docherty having attended five dayes in a Controversie between Jno. Strawbridge. plt & Edward: Jones. deft for the deft Craves Order for Attendance, and your Petioner as in duty bound shall ever pray &c. June 12th. 1691 Sworne before me in Open Court. Samll. Hopkins. --- June 12th C 1691. Sarah: Dorman having attended Seven days in a Controversie between John Strawbridge plt and Edward Jones deft for the deft. Your worps petioner craves Order for attendance & yr Petionr as in duty bound shall ever pray Sworn before me. James: Round Mary Maxwell. having attended five dayes in a Controversie between John Strawbridge plt, & Edward: Jones deft for ye plt.
