( 123 ) June ye 12th. 1691 Here followeth the Bill - - - - - - - - - - - - - - - - - - - This Bill bindeth me James: Minor of Somerset County in the Province of Maryland my Heirs Execcutrs and Adminstrators. to pay or cause to be paid unto John: Pope of Somerset County Planter his Heirs.Execcutrs Admrs or Assigns. the full and just sum of 13:hundred pounds of good sound Merchantable leafe tobacco and Caske to be at any Convenient Landing in Somerset County, at or upon the 10th. day october next ensueing the date hereof as wittness my hand and seal this last day of January: 1689/90 Jno. Harper. James:Maynard. ? Sealed Nathaniel: Abott. / Bill proved in Open Court the 12th June 1691. Ordered by this Court that the Sheriffe produce his prisoner. at ye next Court - - - - - - - - - - - - - - - - - - - - ht George: Layfield Esqr: plt. Somerset County Ss.---- Walter Lodge of this County Chyrurgeon was attac^ Contra. to answer unto George: Layfield Esqr.Attorney of Isaac:Silver of y Island Walter: Lodge: Deft. of Barbadoes Mercct. in an action upon the Case. - - - - - - - - - - - - - - - - - - - - And whereupon the plt by James: Sangster his Attorney Comes & Sayes that the said Walter:Lodge deft is become and stands indebted unto the sd Isaac:Silver the full and just Sum of fifteen shillings Sixpence, Sterling money being for Severall goods rcd by the sd deft of the sd Isaac:Silver Mercht. as doth and may appear by his accompt here in Court produced. which Said Sum of 15S:6D. money the defendt did faithfully assume and promise to pay, but fraudulently & craftily internding to deceive the plt the same hath denyed to pay and yet doth deny to the plts great losse and damage to the value of One pound eleven shill Sterling money, and hereupon brings this Suite. Ja:Sa. pr Qer. pled prsois Jno. Doe The sd accompt did not appear in Court Rich:Roe Ordered By this Court that the Sheriffe produce Lodge next Crt or Assign y bail Bond Edward: Hammond: plt. Somerset County:Ss. Bryan:Peart of this County Smith was attached to answer unto Contra. Edmund:Hammond of y same County Planter in an accon of detinue. ---------- Bryan: Peart: Deft. And whereupon the plt by James:Sangster his Attorney Comes and Sayes that the - - - - - - - - - - - Said plt did bargain and Sell a Certain Plantation to Matthew:Scarbrough of this County Mercht. and upon ye plts removall from the sd Plantation did leave one Milstone Att the sd Plantation not having Opportunity of transporting the same, which sd Plantation is now in the posession of the Said: deft. Peart who unjustly and malitiously deteineth the sd Milstone, and the further to endamnifie and defraud the plt of the same, hath put it for a block to Support a tobacco house therewith whereby the plt sayes he is damnified and hath losse to the value of twelve hundred pounds of tobacco, and hereupon brings this Suite &c. Ja: Sa pr Quer. pled. Jno. Doe Rich: Roe Plea. viz. Edward: Hamond: Plt And the deft saith that the plt hath no right to the sd Milstone and thereupon Bryan: Peart. Deft puts himself upon the Country. Edward: Jones And the plt replyes & saith that the deft deteineth the sd Milstone wch is the property of the plt.
