( 121:) June 12th. 1691 Aaron Bishop being Sumoned and Sworne gives in this Depos. following viz - - - - - - - - - June ye 12th. 1691: The Deposition of Aaron Bishop Planter. Aged about 37:years.whereas Peter:Loyd absenting himself from me in his Service was taken up by John:Tayler. and brought home to me by the sd Tayler at my house. John: Tayler bargains and agrees with Peter:Loyd, that if the sd Peter would allow the One half of what John:Tayler could gett by Law. from German. Gellett of what tobacco and Corne the sd Gillet was indebted and Owing to Peter:Loyd being fifteen hundred lb. of tobacco, and three barrels of Corne. Then the sd Jno.Tayler would willingly and did agree to pay all Court Charges, and Cost of Suit, and Peter Loyd to pay nothing of either. this the Deponent Saith and no further: June ye. 12th. 1691. Peter. Loyd. Planter aged about 45 years Deponeth ye Same & sayeth and no further. --- The aforesd Jury having heard the forementioned Declaration and plea, the accompt Deposition, and the Oaths of Jno. West and Samll Worthington. having likewise recd their Charge are Sent forth to Consult the same. - - - - - . And now the said Jury being returned, and in Court Calld over by their names, being unamously agree, gives in this following verdict. which is read in the audience of the plt & deft. (viz) We of the Jury findeth One thousand Sixty seven pounds of tobacco for the plt. Jno. Emmet foreman. which verdict this Court hath confirmed MemorandB Every Officer in this Court give his fees in this sd tryall to Jno. Tayler. there is Only 400:pounds of tobacco to be pd to Aaron Bishop and his man for tendance in sd action, which is to be paid by the plt and defendt. as pr advice of Court and Consent of sd Bishop. plt & deft both agreed to the same William: Henderson. Plt. Somerset County Ss. Benjamine Deards of this County Sawyer was Contra attached to answer unto Wm: Henderson of the same County.Planter in Benjamine: Deards:Dft. an action upon the Case. - - - - - - - - - - - - - - - - - - - - - - - - - - - - And whereupon, the plt by James:Sangster his Attorney Comes & Sayes That the deft is become and Stands indebted unto the plt One able man Servant for and dureing the space of tenn years fully to be compleat and ended, the sd deft having allready recd full Satisfaction for the sd Service of and from the plte as also the sum of Six hundred thirty and four pounds of tobacco, charges occasioned by a Certain Cheat the sd deft put upon the plt, in dilivering him (instead of the sd Servant, for tenn years) One John: Davies freeman by a false Indenture, which sd Cheat did plainly appear in 9ber Court to be the Act of the sd deft. the plt not being any way privy thereunto, So that the plt hath demanded either the servant according to bargain or that his money & Charges be returned in kind, which the sd deft hath utterly refused, thereby fraudulently & Craftily intending to deceive the plt both of Servant and money with the Charges. So that the plt is damnified and hath losse to the value of Twenty thousand pounds of tobacco & thereupon brings this Suite. Ja. Sangster prQuer. pled.
