rities and their successors, their agents, workmen
and servants, to enter at any and all times thereafter
upon said premises for the purpose of erecting neces-
sary and convenient works and machines, cutting
and opening trenches, laying and fixing or of repair-
ing pipes and covering the same, and of doing all
such matters and things as may be requisite for
carrying this law into full and complete operation.
SEC. 3. And he it enacted, That the said corporate
authorities and Water Board hereinafter named, shall
have full power and authority to establish reservoirs
and public fountains, in such parts of the streets and
squares of said town as they may think proper, and
the Mayor and Council shall grant to all persons
whomsoever the privilege of using said water so to
he introduced, in such manner, and on such terms
and conditions, and in such quantities respectively,
as they shall think fit, and to pass all ordinances
touching the said water-works, and the distribution of
said water through the town, and in all the streets of
said town as speedily as possible, and it shall be
the duty of the said corporation so to do.
SEC. 4. And be it enacted, That any person or per-
sons, designedly or negligently injuring the said
water-works, or any part thereof, or obstructing the
passage of said water, or negligently, or wilfully
allowing said water to run to waste, or in any way
polluting the same, shall for every offence forfeit and
pay a fine not exceeding one hundred dollars, to be
recovered by said corporate authorities, on warrant
and execution by and before any Justice of the Peace
for Hagerstown, or the County of Washington.
SEC. 5. And be it enacted. That a Water Board be
and the same is hereby created for said town, to con-
feist of William T. Hamilton, George W. Harris, M.
A. Berry, George R. Bowman and Buchanan Schley;
"which board shall continue until the works necessary
to introduce and distribute said water in said town
shall have been completed, when said Water Board
shall cease; and in case of vacancy in said board by
death, resignation or removal during the pendency
of said work, such vacancy shall be filled by appoint-
