LAWS OF MARYLAND.
specified in this Act for the payment of the same,,
the said company shall be liable to a penalty of ten
per centum for such failure, neglect or refusal; and
it shall be the duty of the Comptroller to cause suit
to he brought in the name of the State of Maryland,
against the said company, in the Circuit Court of the
county where the said company is located, or in the
Superior Court of Baltimore city, if the same be
located in said city, and the said suit shall stand for
trial at the first term; and if the court or jury before
whom the same shall be tried shall find for the State,
judgement shall be rendered against the said company
for the amount of taxes so due as aforesaid, and ten
per cent. additional as penalty as aforesaid, with
interest and all costs, and a fee of fifty dollars shall
be allowed the State's Attorney bringing said suit,
to be taxed as part of the plaintiffs costs in said suit,
and execution shall be issued on said judgement if the
same be not paid into the Treasury immediately
upon the rendition thereof.
SEC. 6. And be it further enacted. That in any such
suit service of the writs upon the President, Cashier,
Treasurer or any agents, officer or employee of the
company sued, shall be deemed sufficient service on
said company, and the certificate of the Comptroller,
under seal, of the amount of tax so due as aforesaid,
shall be prima facie evidence to entitle the State to
judgment for said amount and said penalty; and any
engine, car, boat or other property found in the pos-
session of said company, or of any officer, agent or
employee thereof, in the service of said company,
shall be liable to execution and sale for the payment
of the said judgment and costs.
SEC'. 7. And be it further enacted, That whenever
it shall appear to the Comptroller, by the return of
the officers of the said transporting companies as afore-
said, that any coal mining company in tills State has
bowl fide worked its mine, and has paid the tax upon
the coal mined by said company in accordances with
the provisions of this Act, the said Comptroller shall
issue to the said Coal Mining Company, a quietus
for State taxes on the capital stock of said Coal
Mining Company, for the year in which said pay-
