dence; provided, that all affidavits and other evidence
that shall be taken in behalf of the party debtor to
the State shall be defrayed by said party, and the
State shall not be answerable for the same.
SEC. 4. And, be it further enacted, That the Comp-
troller may, whenever in his discretion he may deem
it necessary, or for the interest of the State, to em-
ploy an attorney instead and in place of the State's
Attorney, to assist him in carrying out the provisions
of this Act, which said attorney shall be entitled to
receive the same compensation as is herein allowed
to the State's Attorneys for the same services, and no
more.
SEC. 5. And be it enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 397.
AN" ACT to amend and re-enact section eight of
Public Local Laws, passed February sixteenth,
eighteen hundred and sixty-four, chapter ninety-
six, and the supplement thereto, section three,
chapter twenty-seven, of the Public Local Laws,
passed eighteenth of February, eighteen hundred
and sixty-eight, entitled "an Act a supplement to
an Act passed by the General Assembly of Mary-
land, at January session, eighteen hundred and
sixty-four, chapter ninety-six, entitled an Act to
incorporate the Liberty and New Windsor Turn-
pike Road Company, in Frederick and Carrol
counties."
SECTION 1. Be it enacted by the General Assembly,
That section three, of chapter twenty-seven, of Pub-
lic Local Laws, be amended and re-enacted so as to
read as follows:
