holders may he called by order of the Directors,
or by stockholders holding one-fifth in amount of
the capital stock, by like notice as that required
for annual meetings, specifying, moreover, the ob-
ject of the meeting, but no business shall be trans-
acted at such special meeting unless a majority of
the stockholders shall attend in person or by proxy.

 

Sec. 12. And be it enacted, That the said Com-
pany be and they are hereby authorized to locate
and construct a railroad from some convenient
point in the city of Baltimore, at or near the ter-
minus of the City Passenger Railway on Baltimore
street, or north of the Frederick road, thence by
the Calverton road, Baltimore turnpike and Liberty
road, either or both, or such other route or routes
as they may select, via the junction of the Balti-
more and Liberty turnpike road and Windsor Mill
road to Wetheredsville, Franklintown, Powhattan,

or to any one or all of said places; provided, that
the bed of any or either of the aforesaid turnpike
roads being required for the construction of the
railway herein provided for, the said Railroad Com-
pany may enter into any contract with any or
either of the said turnpike road companies, which
they are hereby authorized and empowered to grant
upon such terms as may be agreed upon between
any or all of such turnpike road companies and
the railroad company hereby incorporated, and not
otherwise; and said Railroad Company may enter
upon any land necessary for locating, laying out
or making the said road, branches or extensions,
or over another route that may be selected, and
may procure land, stone, gravel, earth, wood or
timber for such use, and obtain the right to the
same as hereinafter provided.

Proviso.

Sec. 13. Be it enacted, That the President and
Directors of said Company may agree with the
owner or owners of any lands, earth, gravel, tim-
ber, or other materials, or any improvements for
the construction or repair of said road or its works,
for the purchase or use and occupation of the same,
and in case they cannot agree, or if the owner or
owners, or any of them, be a feme covert, non com-
pos mentis, or out of the State, on application to a
Justice of the Peace of Baltimore county, he shall
issue his warrant, under his hand and seal, directed
