Another
inquisition.

if the said inquisition shall be set aside, the said
Court may in its discretion, as often as may be
necessary, direct another inquisition to be taken in
the manner above described ; provided, that it
shall not be lawful, without the consent of the
owner or owners, to condemn any line for the con-
struction of said railway which shall pass through
the buildings, yards and lawns of any person, or
through any grave-yard or burial place.

Payment
tendered.

Sec. 9. And be it enacted, That upon the payment
or tender of payment to the owner or owners of
the land so condemned, of the amount of damages
that may have been assessed by such inquisition
after the same shall have been confirmed by said
Court, the said Company shall be at liberty to
take possession of said land and materials, and to
construct upon such land, on such grade as they
may deem expedient, their said railway, and put
the same in operation, and take into their posses-
sion and use such materials, and to do all things
that may be lawful for the purposes of their said
railway.

Lateral roads.

Sec. 10. And be it enacted, That it shall and
may he lawful for the said Company to make and
construct lateral roads, subject to the provisions of
the foregoing sections of this Act relating to the
condemnation of land and materials, in cases
where the owner or owners thereof and the said
Company are not able to agree, or where such
owner or owners shall be a feme covert, infant or
non compos mentis.

Issue tonds.

Sec. 11. And be it enacted, That it shall and
may be lawful for the said Company is issue its
bonds or obligations in sums of not less than one
hundred dollars each, and payable with interest at
such time or times as the President and Directors
of said Company may appoint, and to sell and dis-
pose of the same, and to provide for the security
and payment of the same by mortgage or other-
wise, and also that it shall and may be lawful for
the said Company to issue certificates of stock, and
to apply the same, if they shall find it expedient
to do so, in payment of the expenses of the con-
struction and equipment of said road, or other
liabilities of said Company.
