Penalty.

repair and injurious to such road, shall be liable
to be sued in an action of debt before a Justice of
the Peace, in the name of said Commissioners, in
which said action the amount recoverable shall not
be less than five nor more than fifty dollars, either
party having the right of appeal to the Circuit
Court, as in other cases of small debts, and the
sums recovered in any such action to be applied in
the same manner as hereinbefore provided.

Repealed,

Sec. 11. And be it enacted, That all Acts incon-
sistent with this Act be and the same are hereby
repealed.

In force.

Sec. 12. And be it enacted, That this Act shall
take effect from the date of its passage.

CHAPTER 316.

 

AN ACT to Incorporate the Citzens' Bank of Cum-
berland.

Incorpo ration

SECTION I. Be it enacted by the General Assembly
of Maryland, That John Humbird, Lloyd Lown-
dors, Jr., A. F. Cromer, John S. Coombs and
Alexander King be, and they are hereby, ap-
pointed Commissioners with authority to them, or
a majority of them, to establish a banking institu-
tion in the city of Cumberland, by the name of the
"Citizens' Bank of Cumberland," the capital of

shares of one hundred dollars each; and the said
banking institution shall be and is hereby incor-
porated under the name and style of the Citizens'
Bank of Cumberland, and by that name shall have

of law and equity whatsoever, and also shall have
authority to make and use a common seal, and the
same to alter and renew at pleasure, and generally

can lawfully do and execute, and particularly shall
